200403744 <br />the Hall County Register of Deeds for filing of the Construction Lien and Affidavit of Mailing <br />Notice, and [3] attorney's fees. <br />15. Plaintiff, other Defendants, and/or other lienholders may claim to have some interest <br />in and to, or lien upon, the above - described real estate; but whatever interest the Plaintiff, other <br />Defendants and /or other lienholders may have therein is inferior and junior to the lien of this <br />Defendant /Cross - Complainant. <br />WHEREFORE, Defendant /Cross - Complainant C & C Millwork, Inc. prays that the Court <br />proceed to enter an Order herein, as follows: <br />1. For judgment against Defendant Clinton F. John, as Trustee on behalf of the Trust of <br />Clinton W. John, a Revocable Living Trust, for the amount of Eight Thousand Nine Hundred <br />Sixty -seven and 51/100 Dollars ($8,967.51), plus [1] statutory interest thereon from November 1, <br />2003, which interest continues to accrue at the legal rate, [2] Thirty -one and no /100 Dollars <br />($31.00) paid to the Hall County Register of Deeds for filing of the Construction Lien and <br />Affidavit of Mailing Notice, and [3] attorney's fees. <br />2. Ordering that the lien of C & C Millwork be adjudged to be a first, prior and <br />paramount lien upon the above - described real estate. <br />3. Ordering that all right, title and interest, if any, of the Plaintiff and of all of the other <br />Defendants herein be decreed to be junior and inferior to the rights of C & C Millwork and at all <br />times subject thereto. <br />4. Ordering Defendant Clinton F. John, as Successor Trustee of the Clinton W. John <br />Revocable Living Trust, to pay to C & C Millwork the amounts so determined to be due. <br />5.
