<br /> The Undersigned, Anna L. Stehlik, being first duly sworn, deposes and says:
<br /> 1. That I am the Assistant Secretary of Consolidated Blenders, Inc., a Nebraska
<br /> Corporation and make this �davit on behalf of said Corporation.
<br /> 2. That by Warranty Deed dated March 16, 1973, Cornhusker Faxms, a Partnership,
<br /> conveyed to C H Fanns, Inc., a Nebraska Corporation, the following described
<br /> property located in Hall County, Nebraska:
<br /> A certain part of the NW1/4 of the NE1/4 of Section 31, Township 12
<br /> North Range 10 West of the 6�'P.M., which is more particularly described
<br /> as: Commencing at the Northwest Corner of the NW1/4 of the NE1/4 of
<br /> said Section 31; running thence East upon and along the North line of the
<br /> NW1/4 of the NE1/4 of said Section 31, 252.0 feet, to a point on the South
<br /> right-of-way line of the S.B. & Q. Railroad Co., running thence S. 73°46'
<br /> E., 207.4 feet to the actual point of beginning; running thence S. 73°46' E.,
<br /> 370.5 feet; running thence S. 16°14' W., 85.0 feet; running thence S.
<br /> 73°46' E., 459.2 feet; running thence S. 20°O1' E., 19.9 feet; running
<br /> thence S. 0°29' E., 220.0 feet; running thence N. 88°48' W., 173.0 feet;

<br /> 16°14' E., 711.9 feet to the actual point of beginning containing 13.73
<br /> acres more or less; and a tract or parcel of land Fifty feet (50') in width
<br /> • along and paxallel to the Southerly boundary of the right of way of the C.
<br /> B. & Q. Ra.ilroad as the same is now established through the same is now
<br /> established through the NE1/4 of the NE1/4 of Section 31, Township 12
<br /> North, Range 10, West of the 6�'P.M., in Hall County, Nebraska.
<br /> Said Warranty Deed was filed April 27, 1973 in the Office of the Register of
<br /> Deeds of Hall County, Nebraska at Book 171, Page 85.
<br /> 3. That on May 1, 1973, said C H Farms, Inc. filed Articles of Merger with the
<br /> Nebraska Secretary of State by which C. H. Farms, Inc. merged into Consolidated
<br /> Blenders, Inc., a Kansas Corporation. A copy of said Articles of Merger, certified
<br /> to be true and correct by the Nebraska Secretary of State, is attached to this
<br /> �davit as Exhibit A.
<br /> 4. That on July 31, 1998, Blenders, Inc., a Nebraska Corporation, filed Articles of
<br /> Merger/Share Exchange with the Nebraska Secretary of State by which
