<br /> KNOW ALL MEN BY THESE PRESENTS:
<br /> That LEON PLASTICS INC., a Delaware Corporation ,Grantor of �
<br /> the County of Kent , the State of Michigan for and in
<br /> consideration of the sum of one Dollar ($1.00) and other good and valuable consideration, the receipt of which
<br /> is hereby acknowledged, does hereby grant, remise, convey and relinquish unto Northwestern Public
<br /> Service, a Divisiar� of Northwestern Corporation, a Delaware Corporation, Grantee, of Huron, South
<br /> Dakota, its successors or assigns, a gas utility easement, for the installation, maintenance and operation of a ��
<br /> natural gas pipeline, anc: appurtenances thereto, over, under, upon and through the followin described lands k
<br /> The West Ten feet (10') of Lot Eight(8) in the COUNTY SUBDIVISION of the Northwest
<br /> Quarter (NW1/4) and the West One half(W1/2) of the Northeast Quarter(NE1/4) of
<br /> Section Five (S5), Township Ten North (T.10 N.), Range Ten West(R.10 W.) of the Sixth
<br /> (6th) Principal Meridian, Village of Alda, Hall County, Nebraska.
<br /> (The purpose of the above described easement is for a natural gas pipeline along
<br /> with all appurtenances the
<br /> TO HAVE AND TO HOLD unto said NORTHWESTERN PUBLIC SERVICE COMPANY, its successors
<br /> and assigns, so long as such natural gas pipeline and appurtenances thereto shall be maintained and
<br /> operated, together with the right of ingress and egress from said premises for the purpose of surveying,
<br /> constructing, installing, inspecting, repairing, maintaining, renewing and replacing the property of the Grantee
<br /> located thereon, or removed thereof, in whole or in part, at the will of the Grantee.
<br /> Tr�� Urantor further covenants for itself, its, lessees, successors, or assigns, that the Grantee, its
<br /> lessees, succrs�ors or assigns shall at all times have the right to cut and remove or trim all trees, bushes and
<br /> saplings growing upon said lands above described, or extending over same, so far as may be reasonably
<br /> necessary for the construction, reconstruction, operation, repair, and maintenance of said natural gas pipeline,
<br /> and shall have :he right of access and entry to and upon said above described lands for such purposes.
<br /> The Grantee shall pay for all damages to landscaping, gardens, roads and driveways, parking lots,
<br /> signage, sidewalks, fences, livestock, crops and fields, subject to Grantor providing means of ingress and
<br /> e�ress, caused by the construction, reconstructic�n, repair, replacement. or maintenanr,e of said natural aas
<br /> pipeline.
<br /> The Grantor reserves the right to cultivate, use and occupy the above described lands, except that
<br /> Grantor shall not erect any structures or other objects, permanent or temporary, except fences, thereon
<br /> provided, however, grantor shall be permitted to construct, repair, and maintain parking lots, signage and
<br /> sidewalks over said Easement. Grantee also agrees that if relocation of its facilities becomes necessary due to
<br /> building expansion, Grantee will by Quit Claim Deed release tiie existing easement, and at its expense relocate
<br /> the in-place natural gas pipeline along with any related equipment and appurtenances thereto, provided that
<br /> Grantor grants a new easement before relocation of the in-place natural gas pipeline. Grantor further agrees
<br /> that Grantor��,�i!! not perform any act which will interfere with or endanger said natural gas pipeline, that Grantor
<br /> will not plant any trees upon the above described lands without the prior expresse�+ written approval Trom tne
