DEmBOWSKI AND CONNIE J. DEf�80WSKI, husband and wife hereinafter refened to as"Borrower", and HOME FEDERA�, SA�GS AND LOAN � ASSOCIATION OF GRAND ISLAND, hereinafter referred to"as Lender". WITNESSETH: WHEREAS, Bonower did execute Adjustable Rate Note payable to the order of the Lender in the total original amount of TWENTY THOUSAND AND NO/100------------�ollars ($ 20,000.00 )• � WHEREAS, the Note described above was secured by a Deed of Trust with Adjustable Rate Rider dated may 2, , 1994 , filed of record in the Office of the HAI_L County Register of Deeds on i�ay 11 , 199 4 as Document No. g4-103925 in respect to that real estate described as: � LOT FIUE (5), AND THE SOUTHERLY ONE-HALF (S1/2) OF LOT THREE (3), IN BLOCK SIX (6) , UNIUERSITY PLACE, AN ADDITION TO THE CITY OF GRAND ISI_AND, HALL COUNTY, NEBRASKA WHEREAS, Borrower has requested that interest be converted to a fixed rate rather than the variable rate specified by such Deed of Trust with Adjustable Rate Rider and that the stated maturity date be also hereby modified; WHEREAS, Lender is willing to convert such variable rate loan into a fixed rate loan to be secured by such Deed of Trust with Adjustable Rate Rider and modify the existing maturity date; WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust with Adjustable Rate Rider identified hereinabove to provide that it shall continue to secure the presently remaining indebtedness from and after the date hereinafter specified together with a fixed rate of interest rather than a variable rate as originally set forth in such Adjustable Rate Rider; NOW, THEREFORE, it is agree�i: 1. Interest Rate and Maturity Modification. Commencing effective September 1 199� the indebtedness secured by the Deed of Trust with Adjustable Rate Rider hereinabove � identified shall accrue interest at a fixed rate of seven & One-Half percent ( 7•500�0� throughout the remaining term of such indebtedness and, notwithstanding the provisions contained in the Adjustable Rate Rider, there shall be no further adjustments to such inte►-est rate. 1"t�a�nal maturity of such indebtedness as modified, secured by such Deed of Trust shall be �ugust 1, 200� , notwithstanding any other date of maturity which may have been specified in the Deed of Trust hereinabove identified. � 2. Continuing Effect. Except as specifically modified by this Deed of Trust Modification Agreement, all other terms and provisions of the Deed of Trust with Adjustable Rate Rider hereinabove identified shall remain in full force and effect. -1-
