<br /> THIS DEED OF TRUST, made this day of , 1999, by
<br /> and between ROLAND ENGEL, A/K/A ROLAND R. ENGEL AND SAN RA ENGEL, A/K/A
<br /> SANDRA E. ENGEL, A/K/A SANDY ENGEL, HUSBAND AND WIFE, of the County of HALL
<br /> and State of NEBRASKA, hereinafter whether one or more (and if more than one then jointly
<br /> and severally), called "Trustor", and JIM GANZ, JR. of BUFFALO County, Nebraska, a member
<br /> of the Nebraska State Bar Association, hereinafter called "Trustee", and THE EQUITABLE LIFE
<br /> ASSURANCE SOCIETY OF THE UNITED STATES, a NEW YORK Corporation, having its
<br /> principal office and post office address at 1290 AVENUE OF THE AMERICAS, NEW YORK, NY
<br /> 10104 , hereinafter called "Beneficiary";
<br /> WITNESSETH, that the Trustor, for good and valuable consideration, including the debt
<br /> and trust hereinafter mentioned and created, and the sum of one dollar to him paid by the said
<br /> Trustee, the receipt and sufficiency of which is hereby acknowledged, does by these presents,
<br /> irrevocably grant, bargain and sell, convey, assign and confirm unto the said Trustee, IN
<br /> TRUST, WITH POWER OF SALE, for the benefit and security of Beneficiary, under and subject
<br /> to the terms and condition of the Deed of Trust, the following described real property situated in
<br /> HALL County, Nebraska, to wit:

<br /> containing 160 acres, more or less.
<br /> FOR VALUABLE CONSIDERATION, receipt of which is acknowledged, Trustor, as
<br /> debtor, irrevocably grants and assigns to Beneficiary, as secured party, a security interest in all
<br /> of the following collateral which is personal property now or hereafter owned by Trustor or in
<br /> which Trustor now or hereafter has any rights and which is now or hereafter located on or at, or
<br /> affixed or attached to, or produced from, or used in connection with said real property, and all
<br /> substitutions, replacements, additions, accessions, products and proceeds of or to said
<br /> collateral, to wit:

<br /> Together with: all equipment, farm products, crops growing or to be grown, timber, all
<br /> fixtures, improvements, buildings, and the plumbing, heating ventilating and lighting
<br /> systems and equipment therein; all barn equipment; and all pumps, pumping stations,
<br /> motors, engines, machinery, reservoirs, pipes, flumes, fences, and other machinery or
<br /> equipment, except tractors, used for the production of water on said premises or for the
<br /> irrigation or drainage thereof, all of which shall be construed and considered as affixed
<br /> to and part of the real estate.
