<br />member of the Nebraska State Bar Association and Trustee, upon a
<br />Deed of Trust made and entered into on or about July 20, 2001, by
<br />and between Darrell Stuart Hiltzman, a single person, Trustor, and
<br />Jerry L. Schultz and Linell S. Schultz, husband and wife, Benefi-
<br />ciary, and Ronald S. Depue, Trustee, which Deed of Trust was filed
<br />on July 23, 2001 in the Register of Deeds office of Hall County,
<br />Nebraska, as Document No. 0200107251, herein called the Grantor, in
<br />consideration of One Hundred Thirty -three Thousand Dollars
<br />($133,000.00), received from Grantee, does hereby grant, bargain,
<br />sell, convey and confirm unto Jerry L. Schultz and Linell S.
<br />Schultz, husband and wife, as joint tenants, herein called the
<br />Grantee, the following described real property in Hall County,
<br />Nebraska:
<br />Lot Thirteen (13), Block Two (2), Southern Acres Addition
<br />to the City of Grand Island, Hall County, Nebraska.
<br />TO HAVE AND TO HOLD the above described premises together with
<br />all tenements, hereditaments, and appurtenances thereto belonging
<br />and to the Grantee.
<br />Grantor does hereby covenant with Grantee as follows:
<br />1. That Darrell Stuart Hiltzman, Trustor, failed to pay the
<br />Beneficiary payments which were contractually due and the Grantor,
<br />at the request of the Beneficiary, elected to declare the entire
<br />unpaid principal balance together with interest thereon at once
<br />immediately due and payable;
<br />2. That a notice of default was filed by Grantor on January
<br />12, 2004, in the Register of Deeds office of Hall County, Nebraska,
<br />as Document No. 0200400348. A copy of the notice of default was
<br />served upon Darrell Stuart Hiltzman, Trustor, by certified mail,
<br />postage prepaid on January 16, 2004;
<br />3. The Trustor, Darrell Stuart Hiltzman, failed to cure the
<br />default referenced in the notice of default within thirty days
<br />after the service of the notice of default;
