<br />  	KNOW ALL MEN BY THESE PRESENTS:
<br />    		That       	RONALD V. JELINEK and DANA L. JELINEK/ Husband and Wife    	,Grantors
<br />  	of the County of    		Hall      		, the State of    		Nebraska       	for and in
<br />  	consideration of the sum of one Dollar ($1.00) and other good and valuable consideration, the receipt of which
<br />  	is hereby acknowledged, do hereby grant, remise, convey and relinquish unto Northwestern Public Service,
<br /> 	a Division of Northwestern Corporation, a Delaware Corporation, Grantee, Huron, South Dakota, its
<br /> 	successors or assigns, a utility easement, for the installation, maintenance and operation of a natural gas
<br />  	pipeline, and appurtenances thereto, over, under, upon and through the following described lands situated in

<br />    		Fractional Block One Hundred One (101) of Railroad Addition to the City of Grand Island,
<br />   		and its complement to wit: Fractional Lot Three (3) in Fractional Block One Hundred One
<br />    		(101) of Koenig and Wiebe's Addition to the City of Grand Island, all a part of the
<br />   		Southeast Quarter(SE1/4) of Section Sixteen (S16), Township Eleven North (T.11 N.),
<br />    		Range Nine West(R.9 W.) of the Sixth (6th) Principal Meridian, Hall County, Nebraska.

<br />    		along with all appurtenances thereto).
<br />   		TO HAVE AND TO HOLD unto said NORTHWESTERN PUBLIC SERVICE COMPANY, its successors
<br />� 	and assigns, so long as such natural gas pipeline and appurtenances thereto shall be maintained and
<br /> 	operated, together with the right of ingress and egress from said premises for the purpose of surveying,
<br /> 	constructing, installing, inspecting, repairing, maintaining, renewing and replacing the property of the Grantee
<br /> 	located thereon, or removed thereof, in whole or in part, at the will of the Grantee.
<br />   		The Grantors further covenants for themselves, their heirs, lessees, successors, or assigns, that the
<br /> 	Grantee, its lessees, successors or assigns shall at all times have the right to cut and remove or trim all trees,
<br /> 	bushes and saplings growing upon said lands above described, or extending over�ame, so far as may be
<br /> 	reasonably necessary for the construction, reconstruction, operation, repair, and maintenance of said natural
<br /> 	gas pipei�i�e, and sh�i��a�e�r�e riyht o#access�artct-cntry#tr and apvrr.  '

<br />   		The Grantee shall pay for all damages to landscaping, gardens, roads and driveways, fences, livestock,
<br /> 	crops and fields, supject to Grantors providing means of ingress anc; egress, caused by the construction,
<br /> 	reconstruction, repair, replacement, or maintenance of said natural gas pipeline.
<br />   		The Grantors reserve the right to cultivate, use and occupy the above described lands, except that
<br /> 	Grantors shall not erect any structures or other objects, permanent or temporary, except fences, thereon.
<br /> 	Grantors further agree that they will not perform any act which will interfere with or endanger said natural gas
<br /> 	pipelines, that they will not plant any trees upon the above described lands without the prior expressed written
<br /> 	approval from the Grantee.												����5
