DACA45-2-99-6070 <br /> DEPARTMENT OF THE ARMY <br /> EASEMENT FOR PIPELINE RIGHT-OF-WAY <br /> LOCATED ON <br /> CORNHUSKER ARMY AMMUNITIONS <br /> HALL COUNTY, NEBRASKA <br /> THE SECRETARY OF THE ARMY under and by virtue of the authority vested in the <br /> Secretary by Title 10, United States Code, Section 2669, having found that the granting of this <br /> easement will be in the public interest and will not substantially injure the interests of the United <br /> States, hereby grants to NorthWestern Public Service, a Division of NorthWestern Corporation, a <br /> Delaware corporation, with its principal office at 600 Market Street West, Huron, South Dakota <br /> 57350, hereinafter referred to as the grantee, an easement for a natural gas distribution system, <br /> consisting of 35,522 lineal feet of Weight A, Class 1, steel pipe varying from three to eight inches in <br /> diameter, including all right, title, and interest in and to said pipeline and appurtenances located <br /> thereon, hereinafter referred to as the facilities, over, across, in and upon lands of the United States <br /> as described on Exhibit "A", and depicted on Exhibit "B", hereinafter referred to as the premises, <br /> which is attached hereto and made a part hereof. <br /> THIS EASEMENT is granted subject to the following conditions. <br /> 1. TERM <br /> This easement is granted in perpetuity. <br /> 2. CONSIDERATION <br /> As consideration for the facilities conveyed herein, the grantee shall pay the United States the <br /> amount of One Hundred Thirty Thousand and No/100 ($130,000.00), the receipt and sufficiency of <br /> which is hereby acknowledged. Further, the grantee shall operate and maintain said facilities located <br /> with the easement area for the benefit of the United States and the general public in accordance with <br /> the terms herein set forth. <br /> 3. NOTICES <br /> All correspondence and notices to be given pursuant to this easement shall be addressed, if to <br /> the grantee, to NorthWestern Public Service, 600 West Market Street, Huron South Dakota 5'7350- <br /> 1500, and if to the United States, to the District Engineer, Attention: Chief, Real Estate Division, <br /> 215 North 17th Street, Omaha, Nebraska 68102-4978, or as may from time to time be directed by <br /> x <br />
