99 10791� <br /> 1. Residential Development. The proposed development constitutes a planned <br /> unit development pursuant to Section 36-30 of the Grand Island City Code. For that reason, the <br /> Subdivider agrees that the continuing requirements of Section 36-30 of the Grand Island City Code <br /> pertaining to residential development under the Planned Unit Development, will be complied with <br /> by the developer. The Subdivider also agrees to develop and landscape the property in accordance <br /> with the proposed Building Elevations and Development Master Plan for The Village Subdivision, <br /> revised March 2, 1999, and approved by City Council on March 8, 1999. <br /> 2. Paving. The Subdivider agrees to waive the right to object to the creation of <br /> any paving or repaving district for Ramada Road and Woodland Drive where they abut the <br /> subdivision. The Subdivider agrees to pave all private roads, including installation of sidewalks, as <br /> shown on the RD development Master Plan approved for this subdivision. <br /> 3. Water. The Subdivider agrees to petition the City for creation of a public <br /> water main district to extend, connect and provide water service to the subdivision, and to pay all <br /> special assessments levied in connection with said district. The Subdivider agrees to hire a <br /> professional engineer to prepare construction plans and specifications, and to provide construction <br /> staking and inspection services, to certify all work has been done in accordance with plans and <br /> specifications approved by the Directar of Utilities. The city Utilities Department will advertise the <br /> work for bids, administer the contract, make all contractor payments, and prepare the special <br /> assessment schedule. The city Utilities Department shall be paid four percent (4%) of the total <br /> contract amount for providing their services. <br /> 4. Sanitary Sewer. The Subdivider agrees to petition the City for creation of <br /> a sanitary sewer district to extend, connect and provide sanitary sewer service to the subdivision, and <br /> - 3 - <br />
