<br /> KNOW ALL MEN BY TI�SE PRESENTS:
<br /> That a Deed of Trust was made and entered into on or about October 24, 1997, by and between
<br /> Russell A. Bixenmann, an unmarried person, as Trustor, and United Nebraska Bank, Beneficiary, wherein
<br /> Commercial Federal Bank, a Federal Savings Bank was named Trustee. This Deed of Trust was recorded
<br /> October 24, 1997 in the Records of the Register of Deeds of Hall County, Nebraska as Instrument No.
<br /> 97-108926.
<br /> On or about October 24, 1997,Unite�i Nebraska Bank, Beneficiary, assigned all of its right, title and
<br /> beneficial interest in the Deed of Trust to Commercial Federal Mortgage Corporation. The Assignment was
<br /> recorded October 24, 1997, in the office of the Register of Deeds of Ha11 County, Nebraska, as Instrument
<br /> No. 97-108927.
<br /> Hereinafter the Trustee, Commercial Federal Bank, a Federal Savings Bank, will be referred to as
<br /> GRANTOR.
<br /> The GRANTOR in consideration of Fifty-Seven Thousand Three Hundred Ninety-One Dollars
<br /> and Ninety-Nine Cents($57,391.99)and other valuable consideration received from Commercial Federal
<br /> Mortgage Corporation, hereinafter GRANTEE, does hereby grant, bargain, sell, convey and confirm unto
<br /> GRANTEE the following described real property in Ha11 County, Nebraska:
<br /> The South Ha1f of the West Half(S'/zW'/z) of the East Two Hundred Seventy(270) feet
<br /> of Lot Twelve(12), of Vantine's Subdivision Located on a Part of the Northwest Quarter
<br /> (NW 1/4) of Section Twenty-Two (22) in Township Eleven(11)North Range Nine (9)
<br /> West of the 6th P.M., in Hall County, Nebraska
<br /> To have and to hold the above-described premises together with all tenements, hereditaments and
<br /> appurtenances thereto belonging unto the GRANTEE, and to GRANTEE'S successors and assigns forever.
<br /> GRANTOR does hereby covenant with the GRANTEE and with the GRANTEE'S successors and
<br /> assigns:
<br /> (1) That Russell A. Bixenmann, an unmarried person, as Trustor, failed to pay the Beneficiary
<br /> payments which were contractually due, and the GRANTOR, at the request of the Beneficiary, elected to
<br /> declare the entire unpaid principal balance, together with interest thereon, at once immediately due and
<br /> payahle.
<br /> (2) That a Notice of Default was recorded by GRANTOR on February 26, 1999, as Instrument
<br /> No.99-102080, in the records of the Register of Deeds, Hall County, Nebraska. Within ten (10) days
<br /> thereafter, a copy of the recorded Notice of Default was mailed by certified mail, postage prepaid, to a11
<br /> paities entitled to notice, pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. § 76-1008
<br /> (Reissue 1996).
<br /> (3) T'hat Trustor,Russell A.Bixenma�u�, an unmarried persoq failed to cure the default referenced
<br /> in the Notice of Default within 30 days after the recording of the Notice of Default.
