<br />AFFIDAVIT
<br />I, Lee D. Wagner, being first duly sworn, upon oath deposes and says as follows, to wit:
<br />I . On this date, he is a Registered Land Surveyor in the State of Nebraska, and is now Vice - President of
<br />Benjamin & Associates, Inc., Engineers and Surveyors, Grand Island, Nebraska.
<br />2. Affiant further states that on March 25, 2004, he competed a survey of "PLEASANT VIEW
<br />THIRTEENTH SUBDIVISION ", in the City of Grand Island, Nebraska, a plat thereof being on record at
<br />the Register of Deeds Office located in the Hall County Administration Building.
<br />3. Affiant further states that he has this date re- examined the plat of "PLEASANT VIEW THIRTEENTH
<br />SUBDIVISION ", and has discovered an error on SHEET 2 OF 2 in the fourth line from the bottom of the
<br />"LEGAL DESCRIPTION" portion on the plat pertaining to a distance shown in written letter form and in
<br />parenthesis shown in numerical form.
<br />4. Affiant further states that the fourth line from the bottom of the "LEGAL DESCRIPTION" portion on
<br />SHEET 2 OF 2 of the plat shall now read "a distance of One Hundred Eighty Five (185.0) feet to the
<br />southeast corner of Lot Eight (8), Block Two (2), said Pleasant ", in lieu of "a distance of One Hundred
<br />Twenty Five (125.0) feet to the southeast corner of Lot Eight (8), Block Two (2), said Pleasant ", being
<br />erroneous, null and void.
<br />Further Affiant Saith Not.
