THIS MEMORANDUM OF LEASE OPTION AGREEMENT is made this
<br />day of 1 2004, by and between John R.
<br />Gunderson, trustee or the JOCAR Living Trust, whose address is
<br />#29 Kuester Lake, Grand Island, Nebraska 68801 ("Lessor") and Mr.
<br />G's Car Care Center, Inc., a Nebraska corporation, whose address
<br />is 623 S. Locust, Grand Island, Nebraska 68801 ( "Lessee ").
<br />WITNESSETH:
<br />WHEREAS, Lessor is the owner of a certain tract of real
<br />estate located at 623 S. Locust, Grand Island, Nebraska 68801 and
<br />more particularly described on Exhibit A attached hereto ( "the
<br />real estate "); and
<br />WHEREAS, pursuant to that certain Lease Option Agreement
<br />entered into by and between Lessor and Lessee on
<br />lh.,4 -pC1, 1 e , 2004, Lessor has granted Lessee the option to
<br />purchase the real estate; and
<br />WHEREAS, Lessor and Lessee have agreed to execute and to
<br />deliver this Memorandum of Lease Option Agreement for the purpose
<br />of establishing the lease and option as a matter of public record.
<br />NOW, THEREFORE, IT IS AGREED by and between Lessor and Lessee
<br />as follows:
<br />1. The term of the option to purchase the real estate is
<br />scheduled to expire December 31, 2023, unless otherwise
<br />terminated in accordance with the terms of the Lease
<br />Option Agreement.
<br />2. This Memorandum of Lease Option Agreement is intended
<br />solely to establish the option of Lessee as a matter of
<br />public record. Reference is hereby made to the Lease
<br />Option Agreement for a complete description of all of
<br />the rights, duties and obligations of the parties.
