<br />TRUSTEE'S DEED
<br />This instrument, made this 4 day of December, 2001, between Eric H. Lindquist, a
<br />member of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ",
<br />pursuant to a power of sale contained in that certain Deed of Trust recorded on April 2, 2001, as
<br />Instrument No. 200102716 in the office of the Register of Deeds of Hall County, Nebraska, and a
<br />Bankers Trust Company, as Custodian, hereinafter called "Grantee ":
<br />WHEREAS, on September 20, 2001, Eric H. Lindquist, as Successor Trustee, executed a
<br />Notice of Default pursuant to which notice was given to Jeremy Gillam, a single person, Trustor,
<br />under that certain Deed of Trust recorded on April 2, 2001, as Instrument No. 200102716 in the
<br />office of the Register of Deeds of Hall County, Nebraska, covering that certain premises described
<br />as:
<br />Lot 5, Block 5, Kay Dee Subdivision, City of Grand Island, Hall County, Nebraska,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on October 1, 2001, as Instrument No. 0200109939 in the Records of said
<br />County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on November 6, 2001, Grantor caused to be published in The
<br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a
<br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check at the lower level lobby of the Hall County Courthouse, 1st & Locust Street, Grand
<br />Island, Nebraska at 10:00 a.m. on December 17, 2001. Publication of such notice was made for
<br />five consecutive weeks on November 6, 2001, November 13, 2001, November 20, 2001, November
<br />27, 2001 and December 4, 2001, the last publication being at least ten (10) days but not more than
<br />thirty (30) days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, Ronald S. DePue, attorney for Eric H. Lindquist,
<br />Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale, offer said
<br />property for sale at public auction, and did sell the same to Grantee for the sum of $112,200.00, it
<br />being the highest bidder therefor.
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $112,200.00 so
<br />bid and paid as aforesaid, I, Eric H. Lindquist, Successor Trustee, do hereby grant and convey unto
<br />said Grantee, its successors and assigns forever, all the estate, right, title and interest of which the
<br />said Jeremy Gillam, a single person, and his successors in interest, were seized or possessed at the
