� � �9 �os��� <br /> against whom enforcement of any waiver, change, discharge or <br /> termination is sought . <br /> 17 . RECONVEYANCE BY TRUSTEE. Upon written request of <br /> Beneficiary stating that all sums secured hereby have been paid, <br /> and upon surrender of this Deed of Trust and the Loan A�reement to <br /> Trustee, and upon payment by Trustor of Trustee ' s fees, Trustee <br /> shall reconvey to Trustor, or the person or persons legally <br /> entitled thereto, without warranty, any portion of the Trust Estate <br /> then held hereunder. The recitals in such reconveyance of any <br /> matters or facts shall be conclusive proof of the truthfulness <br /> thereof . The grantee in any reconveyance may be described as "the <br /> person or persons legally entitled thereto. " <br /> 18 . NOTICES . Whenever Beneficiary, Trustor or Trustee shall <br /> desire to give or serve any notice, demand, request or other <br /> communication with respect to this Deed of Trust, each such notice, <br /> demand, request or other communication shall be in writing and <br /> shall be effective only if same is delivered by personal service or <br /> mailed by certified mail, postage prepaid, return receipt <br /> requested, addressed to the address set forth at the beginning of <br /> this Deed of Trust . Any party may at any time change its address <br /> for such notices by delivering or mailing to the other parties <br /> hereto, as aforesaid, a notice of such change. <br /> 19 . ACCEPTANCE BY TRUSTEE. Trustee accepts this Trust when <br /> this Deed of Trust, duly executed and acknowledged, is made a <br /> public record as provided by law. <br /> 20 . SECURITY AGREEMENT. To the extent allowed by the <br /> Nebraska Uniform Commercial Code, this Deed of Trust shall be <br /> self-operative and constitute a Security Agreement and Financing <br /> Statement with respect to the Trust Estate. Trustor hereby agrees <br /> to execute and deliver on demand and hereby irrevocably constitutes <br /> and appoints Beneficiary the attorney-in-fact of Trustor, to <br /> execute, deliver and, if appropriate, to file with the appropriate <br /> filing officer of office such security agreements, financing <br /> statements or other instruments as Beneficiary may request or <br /> require in order to impose or perfect the lien or security interest <br /> hereof more specifically thereon. A photographic or other <br /> reproduction of this Deed of Trust or of any financing statement <br /> relating to this Deed of Trust shall be sufficient as a financing <br /> statement . <br /> 21 . NONRECOURSE. Anything herein contained to the contrary <br /> notwithstanding, other than as set forth in the Purchase Agreement, <br /> (a) Trustor or any of its present or future partners is not <br /> personally liable under the Project Loan Documents, it being <br /> intended that Trustor' s obligation to make payments is included for <br /> the sole purpose of establishing the existence of the indebtedness <br /> represented thereby and (b) in the Event of Default, the <br /> Beneficiary shall look solely to the property which is the subject <br /> 13 <br />
