<br />Ronald L. Headley, being first duly sworn, deposes and says: _r�5_
<br />1. That the Affiant is the successor trustee of the Reva L.
<br />Headley Revocable Trust dated October 25, 1999 (hereinafter
<br />referred to as the "said Trust ").
<br />2. That on February 2, 2004, the Affiant became the
<br />successor trustee of the said Trust following the death of Reva L.
<br />Headley, the settlor and initial trustee of said Trust, on June 11,
<br />2003, a certified copy of the death certificate is attached hereto
<br />and marked as Exhibit "A", and the resignation of Sandra K.
<br />Headley, a copy of which is attached hereto and marked as Exhibit
<br />"B ", and the acceptance of the Affiant, a copy of which is attached
<br />hereto and marked as Exhibit "C ".
<br />3. That the Affiant remains the sole trustee of the said
<br />Trust as of this date.
<br />4. That among the assets of the said Trust is the following
<br />described real property:
<br />The West One Half of the Northeast Quarter (W2NE4) of
<br />Section Eight (8), Township Ten (10) North, Range Twelve
<br />(12), West of the 6th P.M., Hall County, Nebraska;
<br />The North Half of the Southeast Quarter (NZSE4) in
<br />Section Eight (8), Township Ten (10) North, Range Twelve
<br />(12), West of the 6th P.M., Hall County, Nebraska;
<br />The Southeast Quarter (SE4) of Section Six (6), Township
<br />Ten (10) North, Range Twelve (12) West of the 6th P.M.,
<br />Hall County, Nebraska, EXCEPT a tract of land described
<br />as follows:
<br />Beginning at the southwest corner of said Southeast
<br />Quarter (SE4); thence running northerly along the west
<br />line of said Southeast Quarter (SE4) a distance of two
<br />thousand six hundred forty -four and ninety -six hundredths
<br />(2,644.96) feet to the northwest corner of said Southeast
<br />Quarter (SE4); thence running easterly along the north
<br />line of said Southeast Quarter (SE4); thence running
