<br />THIS DEED OF TRUST is made this 'e IVI day of March, 2004, by and among KEVIN
<br />L. LOCKHART and SANDRA S. LOCKHART, husband and wife, herein referred to as
<br />"Trustor ", whose mailing address is 4612 Deva Drive, Grand Island, Nebraska 68801; BRUCE I.
<br />SMITH, Attorney -at -Law, hereinafter referred to as "Trustee ", whose mailing address is P. O.
<br />Box 790, Grand Island, Nebraska 68802; and JERRY L. NEWMAN and SANDRA L.
<br />NEWMAN, husband and wife, as joint tenants with rights of survivorship, hereinafter referred to
<br />as "Beneficiary ", whose mailing address is 6100 Dark Canyon Road, Rapid City, South Dakota
<br />57702 -8509.
<br />For valuable consideration, Trustor irrevocably grants, transfers, conveys and assigns to
<br />Trustee, in trust, with power of sale, for the benefit and security of Beneficiary, under and sub-
<br />ject to the terms and conditions of this Deed of Trust, the Trustor's interest in the following -
<br />described property located in Hall County, Nebraska, to -wit:
<br />A tract of land comprising a part of the East Half of the Northeast Quarter
<br />(E' /zNE' /4) of Section Twelve (12), Township Eleven (11) North, Range Ten (10)
<br />West of the 6th P.M., Hall County, Nebraska, more particularly described as
<br />follows:
<br />Commencing at a point seventy -five (75) feet East of the Northwest Corner of
<br />said East Half of the Northeast Quarter (E' /zNE` /4) on the North line of said East
<br />Half of the Northeast Quarter (E' /zNE' /4); thence continuing easterly along the
<br />North line of said East Half of the Northeast Quarter (E' /zNE' /4) a distance of two
<br />hundred (200) feet; thence southerly and parallel to the westerly line of said East
<br />Half of the Northeast Quarter (E' /zNE' /4) a distance of two hundred seventeen and
<br />eight tenths (217.8) feet; thence westerly and parallel to the North line of said
<br />East Half of the Northeast Quarter (E' /2NE' /4) a distance of two hundred (200) feet
<br />to a point on the easterly right of way of US. Highway No. 281; thence northerly
<br />along and upon the East right of way line of U.S. Highway No. 281 a distance of
<br />two hundred seventeen and eight tenths (217.8) feet to the point of beginning.
<br />together with all improvements, fixtures and appurtenances located thereon or in any way per-
<br />taining thereto, and the rents, issues, profits, reversions and the remainders thereof, including all
<br />such personal property that is attached to the improvements so as to constitute a fixture, all of
<br />which, including replacements and additions thereto, are hereby declared to be a part of the real
<br />estate conveyed in trust hereby, it being agreed that all of the foregoing shall be hereinafter
<br />referred to as the "Property ".
<br />FOR THE PURPOSE OF SECURING:
<br />(a) the payment of indebtedness evidenced by Trustor's note of
<br />even date herewith in the principal sum of THIRTY -SEVEN
<br />THOUSAND AND NO/ 100 DOLLARS ($37,000.00), together with inter-
<br />est at the rate provided therein, or the principal and interest on any future
<br />advance not to exceed the total principal sum initially secured hereby as
<br />evidenced by promissory notes stating they are secured hereby, and any
<br />and all renewals, modifications and extensions of such notes, both princi-
<br />pal and interest on the notes being payable in accordance with the terms
<br />set forth therein, which by this reference is hereby made a part hereof,
