THIS AGREEMENT, made February 12, 2004 by and between HomEq Servicing Corporation, successor by merger to TMS Mortgage, Inc., dba The Money Store , present owner and holder of the Deed of Trust and Note first hereinafter described and hereinafter referred to as "Beneficiary" and Principal Residential Mortgage , Inc.; WITNESSETH THAT WHEREAS Thomas A. Consbruck and Kathleen S. Consbruck, husband and wife did execute a Deed of Trust, dated June 19, 1998 to ATM Corporation of America as Trustee covering : PROPERTY MORE FULLY DESCRIBED IN SAID DEED OF TRUST To secure a Note in the sum of $33,500.00, dated June 19, 1998 in favor of TMS Mortgage, Inc., dba The Money Store which Deed of Trust was recorded June 23, 1998, Instrument No. 98- 106079, Book xxx, Page xxx Official Records of Hall County, State of Nebraska; and WHEREAS, Owner has executed, or is about to execute a Deed of Trust and Note in the sum not to exceed $102,962.00, in favor of Principal Residential Mortgage , Inc. hereinafter referred to as "Lender ", payable with interest and upon the terms and conditions described therein, which Deed of Trust is to be recorded concurrently herewith; and WHEREAS, it is a condition precedent to obtaining said loan that said Deed of Trust last above mentioned shall unconditionally be and remain at all times a lien or charge upon the land herein before described, prior and superior to the lien or charge of the Deed of Trust first above mentioned; and WHEREAS, Lender is willing to make said loan provided the Deed of Trust securing the same is a lien or charge upon the above described property prior and superior to the lien or charge of the Deed of Trust first above mentioned and provided that Beneficiary will specifically and unconditionally subordinate the lien or charge of the Deed of Trust first above mentioned to the lien or charge of the Deed of Trust in favor of Lender; and RETURN TO (NLS).
