<br />EASENENT FOR ELECTRIC TRANSMISSION LINE
<br />KNOW ALL MEN BY THESE PRESENTS:
<br />` That 'Ault County, Nebraska, a body politic and corporate, in consideration of S 1.00, receipt of which is hereby
<br />acknowledged, and the further payment of a sun to make total payment of S1,00, does) hereby grant and convey unto Nebraska
<br />Public Power District (hereinafter tatted District), its lessees, successor. and asai9ns, the permanent right, prlvile9e, and
<br />easement of right�of -way to construct, operate, maintain, inspect, repair, remove, alter, relocate and reconstruct its
<br />mlect -ic transmission lines, including all necessary poles, wires, goys and other equipment used in connection therewith,
<br />ono a route described herein. The Centerline of the electric transmission line shall be established by the actual location
<br />of the electric transmission line as originally constructed on said premises. The location of the right -of -wry is described
<br />as follows:
<br />An easement area being a strip of land over, Cutler, upon and across a portion of Government Lot 2 and the accretion
<br />thereto, and a portion /
<br />th the Northeast Quarter of the Northeast Quarter ell in Section 21, Township 10 North,
<br />Range 9 Vas[ of the 6P.N., Hall County, Nebraska, EXCEPT that portion deeded to the State of Nebraska for
<br />Interstate Highway No. 80 right-of -way and EXCEPT for South Locust Street right-cf -way, said easement area is shown
<br />cn Exhibit " A" attached hereto and incorporated herein.
<br />Tnu easement area for the electric transmission tine contains 1.95 acres more or less.
<br />The District shalt have the right of ingress and egress across end along the property within the easement area for any
<br />purpose - connection with the survey, construction, operation, maintenance, inspection, repair, removal, alteration,

<br />therewith.

<br />trees which in fatting could come within fifreen (15) feet of the nearest electric line conductor. Al( refuse from such tree
<br />carting or trinm'ny shall be burned or mo reved by the District, and the District shall have the right to control by chemicals
<br />all ceads, trees, and brush along the described right -of-way if said right -of -way is not being aft ll Red for cultivated crops.

<br />The District agrees to take all reasonable steps to restore, a s nearly as possible to the condition it was in prior 1.
<br />constructice, &It law in the easement area which is damaged as areeult of said construction.

<br />, cse, and enjoy the land within the eosent area, provided that such use sha not endanger or be
<br />hazard to or interfere with the survey, construction, reconstruction, repair, maintenance, inspection, operation,
<br />a tx erati on, reiccntion rod r s vat of the Uistrici' electric transmission lines. It is further agreed that the Grantor wi;l
<br />not be allowed to place and maintain buildings, structures, hey or straw stacks within the easement area without first
<br />obtaining express written permission from the District for such placements.
<br />The District agrees that should said rightOf -way not be used for the purposes herein stated, or should any transmission line
<br />r nstrected hereunder be removed and not replaced by another transmission tine, for a period of five years, the right of-woy
<br />and easement hereby secured shall than cease and terminate, and this instrument shalt be of ne further force and effect.
