LICENSE AGREEMENT This License Agreement is made by and between the CITY OF GRAND ISLAND, NEBRASKA, a Municipal Corporation, herein referred to as the "Licensor" and the UNITED STATES OF AMERICA, hereinafter referred to as the "Licensee." 1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set forth the terms and conditions under which the Licensee may construct, maintain, repair, and utilize the following described improvement which will infringe upon right -of -way held by the Licensor: (A) Placement of three (3) monitoring wells by the U.S. Army Corps. of Engineers in the sidewalk along the east side of the property at 4005 Norseman Avenue, also known as Lot Thirty Two (32), Jeffrey Oaks Third Subdivision in the city of Grand Island, Hall County, Nebraska. Said monitoring wells shall be flush with such sidewalk area. Such monitoring wells will replace the monitoring wells located at 2019 North North Road. (B) Installation and placement of three (3) monitoring wells by the U.S. Army Carps_ Of Engineers in the sidewalk along the cast property line of 2636 Carleton Avenue, also known as Lot Eighteen (18), Bosselman Second Subdivision in the city of Grand Island, Hall County, Nebraska. Said monitoring wells shall be flush with such sidewalk area. Such monitoring wells will replace the monitoring wells located in Lot One (1) North Pointe Subdivision. The exact placement of such monitoring wells on the property identified above shall be coordinated with the Licensor's Public Works Department. 2. LICENSEE'S DUTIES AND RISKS. It is understood and agreed that the Licensee may construct, maintain, repair and utilize the above described improvement at the Licensee's sole risk.
