4. 200401970 RESOLUTION #04 -r�n8 A RESOLUTION TO VACATE LOT 1 OF DENMAN FARMS SUBDIVISION EXCEPT FOR ALL DEDICATED RIGHT -OF -WAY FOR ALDA ROAD AND TO PROVIDE FOR THE RECORDING OF THIS RESOLUTION IN THE OFFICE OF THE REGISTER OF DEEDS OF HALL COUNTY, NEBRASKA WHEREAS the property owners Danny D. Denman and Catherine M. Denman petitioned the Hall County Regional Planning Commission, the Village of Alda and the Hall County Board of Supervisors to Vacate Lot One (1) of Denman Farms Subdivision and release the driveway easement thirty (30) feet in width upon and platted with Lot One (1) of Denman Farm Subdivision, and; WHEREAS the Hall County Regional Planning Commission, at their meeting held February 11, 2004, recommended that the same be vacated and released. BE IT RESOLVED BY THE HALL COUNTY BOARD OF SUPERVISORS as follows: SECTION 1. That Lot One (1) of Demean Farms Subdivision and the driveway easement thirty (30) feet in width upon and platted with Lot One (1) of Denman Farm Subdivision as approved by the Board of Supervisors of Hall County, Nebraska, on November 17, 1992 is hereby vacated and released. SECTION 2. The County of Hall hereby retains all public right -of -way previously dedicated or otherwise acquired within the Southeast Quarter (SE '/4) of Section Thirty -one (31), Township Eleven (11) North, Range Ten (10) West of the 6th P.M, Hall County, Nebraska. SECTION 3. This resolution shall be recorded in the office of the Register of Deeds of Hall County, Nebraska. SECTION 4. Any resolution or parts of resolutions in conflict herewith be, and hereby are, repealed. SECTION 5. This resolution shall be in force and take effect from and after its passage as provided by law.
