200401724 PROMISSORY NOTE FOR VALUE RECEIVED, the undersigned, Russell A. Supencheck, hereby promises to pay to the order of Florence Ida Wells, Wedgewood Care Center, Grand Island, Nebraska 68801, or at such other place as the holder of this note may from time to time designate, the principal sum of Thirty Thousand Dollars ($30,000.00), with Two percent (2 %) interest per annum, which shall be due and payable as follows: $650.85 payable monthly, commencing January 1, 2004 and each subsequent payment shall be due on the first of every month thereafter until paid in full. Said amount shall be paid in full on or before December 31, 2007 (amortization schedule is attached hereto for reference). Upon any default in the payment of principal or in the performance or observance of any of the covenants or agreements of any instrument now or hereafter evidencing or securing this indebtedness, the installment then remaining unpaid shall bear interest at the rate of Six percent (6 %) per annum while such default exists, and the holder of this note may credit payments received on any amounts due hereunder or under the terms of any instrument now or hereafter evidencing or securing this indebtedness as said holder may determine. No extension of the time for the payment of this note or any installment hereof made by agreement with any person now or hereafter liable for the payment of this note shall operate to release, discharge, modify, change or affect the liability under this note of any of the undersigned not a party to such agreement. Notwithstanding any provision herein or in any instrument now or hereafter securing this indebtedness, the total liability for payments in the nature of interest shall not exceed the limits now imposed by the usury laws of Nebraska.
