<br /> EARL D. AHLSCHWEDE, Attorney of Grand Island, Nebraska, hereinafter /d'D�
<br /> referred to as Grantor, as trustee under the trust deed hereinafter deacribed
<br /> for valuable consideration, hereby grants and conveya to THE EQUITABLE
<br /> BUILDING AND LOAN ASSOCIATION OF GRAND ISLAND, NEBRASKA, a Federal Savinga
<br /> Bank, Grantee, without any covenant or warranty, expressed or implied, all of
<br /> the following described real estate:
<br /> The East Thirty (30) Feet of Lot Eleven (11) and all of Lot Twelve
<br /> (12) , in Block Two (2) , in Boggs & Hill's Addition to the City of
<br /> Grand Island, Hall County, Nebraska; and
<br /> Part of Fractional Lots One (1) and Two (2), in Fractional Block
<br /> Two (2) , in H.G. Clark's Addition to the City of Grand Island,
<br /> Hall County, Nebraska more particularly described as followa, to-
<br /> wit: Beginning at the Southeasterly corner of Fractional Lot One
<br /> (1) , in said Block, running thence in a Northerly direction
<br /> parallel with the Easterly boundary line of said lot a distance of
<br /> Sixty-Six Feet (66' ) , thence in a Westerly direction parallel with
<br /> the Northerly Boundary line of said lot a distance of Seventy
<br /> Seven Feet (77' ) , thence in a Southerly direction a distance of
<br /> Sixty Six Fee (66' ) to the alley of said block, thence in an
<br /> Easterly direction a distance of Seventy-Seven Feet (77' ) to the
<br /> place of beginning, being a rectangular tract of ground having an
<br /> Easterly front of Sixty Six Feet (66' ) on Eddy Street in said City
<br /> and a depth of Seventy Seven Feet (77' ) .
<br /> This conveyance is made pursuant to the powers conferred on Grantor by a trust
<br /> deed dated August 2, 1996, and recorded on August 2, 1996, in the Register of
<br /> Deeda of Hall County, Nebraska as Document No. 96-105993 wherein Donald G.
<br /> Liske and Julie R. Liske, husband and wife, are Trustors, and The Equitable
<br /> Building and Loan Aasociation of Grand Island, Nebraska, a Federal Savings
<br /> Bank is named Beneficiary and Earl D. Ahlschwede, Attorney, is Trustee,
<br /> wherein the Trustors granted and conveyed to such Trustee, on the trust
<br /> therein expressed, the property above described to secure, among other
<br /> obligations, payment of a promissory note of even date in the principal amount
<br /> of $92,000.00 and interest thereon according to the terms thereof; and after
<br /> the fulfillment of the conditions specified in the Trust Deed authorizing this
<br /> conveyance as follows:
<br /> 1) Breach and default were made under the terms of the Trust Deed in
<br /> the particular set forth in the notice of default hereinafter referred to,
<br /> which default continued until the time of sale.
<br /> 2) There was filed for record on March 12, 1999, as Document No.
<br /> 99-102612, a Notice of Default with the Register of Deeds of Hall County,
<br /> Nebraska, and of election to sell the property to satisfy the obligations
<br /> secured thereby and thereafter notice of the filing of the notice of default
<br /> was sent in the statutory manner to all persons entitled to a notice thereof.
<br /> 3) That thereafter the Grantor executed his notice of trustee's sale,
<br /> stating that he, as trustee, would sell at public auction to the highest
<br /> bidder the property hereinbefore described, fixing the time and place of the
<br /> sale as June 2, 1999 at 9:30 a.m. in the lower lobby of the county courthouse
<br /> in Grand Island, Hall County, Nebraska, and caused copies of such notice to be
<br /> published once a week for five consecutive weeks in THE GRAND ISLAND DAILY
<br /> INDEPENDENT a legal daily newapaper printed, published and of general
<br /> circulation in the County of Hall, Nebraska, the first date of publication was
<br /> April 21, 1999, and the last date of publication was May 19, 1999; notice of
<br /> such trustee sale was sent to the Trustors and all persons entitled to notice
<br /> thereof in accordance with applicable iaw.
<br /> 4) All applicable statutory provisions of the State of Nebraska and the
<br /> United States of America and all provisions of such trust deed have been
<br /> complied with as to the acts to be performed and notices to be given.
