� Z A = c.a c� cn m y ca o -� � � � c n 7n�C = y m Z -��c m � �+ c� �c, o -T� � :� � GJ -*i Z � � �- �� 11 m ��'j � D c:z� O y r- :z� a � r i� � � v� �„� cn � � � o � v � i �,.�.a � � � (!� � O DRAINAGE EASEMENT AGREEMENT � � The undersigned, OAK GROVE INNS 2,Inc.,a Corporation, (Grantor), in consideration of � ONE DOLLAR($1.00)AND OTHER VALUABLE CONSIDERATION paid, receipt of which is hereby acknowledge, does hereby grant, bargain, sell and convey to the CITY OF GRAND ISLAND,NEBRASKA, a Municipal Corporation(Grantee), a permanent and perpetual easement for drainage, flood control, storage, monitoring and testing of surface waters in the lake known as Firethorne Lake located on the tract of land described in Exhibit A attached hereto and made a part hereof by reference. The drainage easement granted herein to the City of Grand Island shall be subject to the following mutual terms and conditions: a. The Grantors reserves the right to use the tract of real estate described in Exhibit A including the waters located thereon, in any manner not inconsistent with or in derogation of the drainage easement conveyed herein to the Grantee and may enlazge,reduce or reconfigure the lake located on the Grantors' real estate as the�Grantors may deem necessary and prudent. b. The Grantee may introduce waters into the lake through either the facilities drainage existing at the time of this conveyance or by means of an underground conduit from the right-of-way for Highway 34. The source of the waters subject to this drainage easement shall be limited to the lands shown on diagram Exhibit B attached hereto and made a part hereof. c. The City shall provide an outlet from the Grantor's lake into the lake known as Firethorne Lake or the Wood River. The surface elevation of the outlet shall be sufficiently low to prevent flood damage�o the Grantor's currently existing buildings, fixtures and improvements.
