<br /> THIS DEED OF TRUST is made as of the �7 day of May, 1999, by and among �
<br /> LEROY D. MZLLER, ALLAN E. MILLER and JOYCE E. MILLER, jointly and severally �j
<br /> ("TRUSTOR"), whether one or more, whose mailing address is: //as� .S, /�/C?�/�;d.
<br /> Wood River, Nebraska 68883;
<br /> and ARTHUR C. MAYER, Attorney, ("TRUSTEE") , whose mailing addreas is: Mayer,
<br /> Burns & Ahlschwede, P.O. Box 2300, Grand Island, NE 68802;
<br /> and ROBERT L. RIMA and W. JEAN RIMA, Husband and Wife, as joint tenants and not
<br /> as tenants in cocnmon, ("BENEFICIARIES"), whose mailing address is: 19366 Burmood
<br /> Road, P. O. Box 426, Shelton, Nebraska 68876.
<br /> FOR VALUABLE CONSIDERATION, Trustors irrevocably transfer, convey, and
<br /> assign to Trustee, IN TRUST, WITH POWER OF SALE, for the benefit and security of
<br /> Beneficiaries, under and subject to the terms and conditions of this Deed of
<br /> Truat, the real property located in the County of Hall, State of Nebraska, and
<br /> legally deacribed as follows: (the "Property") :
<br /> The West Half (W'�) of the Southeast Quarter (SE'�) of Section Six (6) ,
<br /> Township Nine (9) North, Range Twelve (12) Weat of the 6th P.M. , Hall
<br /> County, Nebraska, excepting a tract of land described in Book 134 at
<br /> Page 313 of the Deed recorda, and further excepting a tract of land
<br /> described in Instrument No.99-105155 in the Register of Deeds Office,
<br /> Hall County, Nebraska,
<br /> TOGETHER WITH all rents, easements, appurtenances, hereditamenta, interests in
<br /> adjoining roada, streets and alleys, improvements and buildings of any kind situated
<br /> thereon and all personal property that may be or hereafter become an integral part
<br /> of such buildings and improvements.
<br /> The property and the entire estate and interest conveyed to the Trustee are
<br /> referred to collectively as the "Trust Estate".
<br /> FOR THE PURPOSE OF SECURING:
<br /> a. Payment of indebtedness in the total principal amount of $104,000, with
<br /> interest thereon, as evidenced by that certain Promissory Note of even date (the
<br /> "Note") with a maturity date of January 1, 2004, executed by Trustors, which has been
<br /> delivered and is payable to the order of Beneficiaries, and which by this reference
<br /> is hereby made a part hereof, and any and all modifications, extensions and renewals
<br /> thereof, and,
<br /> b. Payment of all sums advanced by Beneficiaries to protect the Trust Estate,
<br /> with interest thereon at the rate of six percent (6$) per annum (ten percent [10�]
<br /> if in default) .
<br /> This Deed of Trust, the Note, and any other instrument given to evidence or
<br /> further aecure the payment and performance of any obligation secured hereby are
<br /> referred to collectively as the "Loan instruments".
<br /> TO PROTECT THE SECURITY OF THIS DEED OF TRUST:
<br /> 1. PAYMENT OF INDEBTEDNESS. Trustors shall pay when due the principal of, and
<br /> the interest on, the indebtedness evidenced by the Note, charges, fees and all other
<br /> sums as provided in the Loan Instruments. The Trustors shall have no right of
<br /> prepayment unless the Beneficiaries consent thereto.
<br /> 2. REAL ESTATE TAXES. Trustors shall pay the annual real estate taxes to the
<br /> Hall County Treasurer before the taxes become delinquent and ahall furnish tax
<br /> receipts to Beneficiaries on or before May 1 and September 1 each year.
<br /> 3. INSURANCE AND REPAIRS. Upon closing, Trustors shall provide Beneficiaries
<br /> with a Certificate of Insurance showing the buildings on each premises to be insured
<br /> for fire and extended coverage in an amount no less than the replacement value of the
<br /> buildinge. Truetors ehall pay the premiume �or maintaining euch policy and ehail
<br /> provide Beneficiaries with evidence of insurance premium payments each year. Such
