GIESE, <br />Petitioner, Case No. 97 -199 <br />VS. JOURNAL ENTRY <br />DANIEL J. GIESE, <br />Respondent. <br />On August 20, 1993, this matter came on to be heard before the Court upon <br />the Application filed herein by the Respondent and the Response thereto by the <br />Petitioner. <br />Neither party was present in court but represented by their respective <br />counsel Patrick Flood for Petitioner and David Schroeder for Respondent. <br />Pursuant to discussion between counsel and the Court the attorney for the <br />Respondent moved to amend by interlineation his Application to include in his <br />prayer request for Nunc Pro Tunc Order and there being no objection such <br />Motion was sustained and the Application of the Respondent was amended by <br />i nteri i neation. <br />Evidence was offered and received and counsel stipulated that the Court <br />take judicial notice of the entire file and Bill of Exceptions. The Court takes the <br />matter under advisement pending review of the file and Bill of Exceptions. <br />Now on September 15, 1993, this matter comes on to the Court for decision, <br />the Court having reviewed the evidence presented and the Bill of Exceptions, <br />court file and exhibits and the Court, being fully advised in the premises, hereby <br />finds and ORDERS as follows: <br />'W C T. d es <br />
