200401510 <br />NOW, THEREFORE, for valuable consideration to Hehnson, receipt whereof is <br />hereby acknowledged, Hehnson does hereby grant and convey to the City, a restriction upon the use, <br />occupancy and maintenance of the following described premises: <br />A 55'x 80' tract of land located on the west property line of Lots One (1), Two (2), <br />Three (3), Four (4), Five (5), Six (6), Seven (7), Eight (8), Nine (9), and Ten (10), <br />Timberline Subdivision, as shown on the attached drawing dated December 16, 2003 <br />and amended January 18, 2004. <br />Hehnson shall, at its sole expense, keep and maintain said premises clear of all <br />structures, paving, fences, trees, and other restrictions or impediments for the use of said premises <br />for an onsite wastewater treatment system (septic field). <br />This restriction on the use of yard space shall be binding upon the parties hereto, their <br />grantees, heirs, successors and assigns in perpetuity, and shall remain in force and effect until such <br />property is served by a municipal sewer system. <br />DATED: January �0 2004. <br />HEHNSON, LLC., <br />A Nebraska limited liability company, <br />Rick S.
