Governing Law. This Second Deed of Trust shail be governed by and construed in acco�dance with the iaws the State of Nebraska. In the event that any provision or clause of any of the Loan Instruments conflicts with applicable laws,s� conflict shall not aNect other provisions of such Loan Instruments which can 6e given effect without the conflicting p�ovision, � to this end the provisio�s of the loan Instruments are declared to be severable. This instrument ca�not be waived, chang discharged or terminated orally, but only by an i�strument in writing signed by the party against whom e�forcement of any wai� change, discharge or termination is sought. 15. Reconveyance by Trustee. Upon written �equest of Beneficiary stating that all sums secu�ed he�eby have bc paid and upon surrender of this Second Ueed of Trust and any note to Trustee for cancellation and retention and upon payment Trustor of Trustee's fees,Trustee shall reconvey to Trustor,or the person or persons legally entitled thereto, without warranty,z portion of the Trust Estate then held hereunde�. The recitals i�such reconveyance of any matters or facts shall be conclusive pr of the truthfulness thereof. Whenever Beneficiary, Trustor or Trustee shall desire to give or serve any notice, demand, request other communication with respect to this Second Deed of Trust, each such notice, demand, request or other communication sl be in writing and shall be effective only if the same is delivered by personal service o� mailed by certified mail, postage prep� return receipt requested, addressed to the address set forth at the bepin�ing of this Second Deed of Trust. Any party may at� time change its address for such notices by delivering or mailing to the other parties hereto, as aforesaid, a notice of such chan 17. Acceptance by Tiustee. T�ustee accepts this Trust when this Second Deed of Trust, duly executed � acknowledged, is made a public record as p�ovided by law. 4
