<br /> KNOW ALL MEN BY THESE PRESENTS:
<br /> That a Deed of Trust was made and entered into on or about October 27, 1995, by and between
<br /> Abelardo Zubia and Bobbi Jean King, both single persons, as Trustors, and Columbus Federal Savings
<br /> Bank, Beneficiary, wherein Commercial Federal Bank, a Federal Savings Bank, was named Trustee.
<br /> This Deed of Trust was recorded November 2, 1995 in the Records of the Register of Deeds of Hall
<br /> County, Nebraska, as Instrument No. 95-107470.
<br /> On or about November 2, 1995, Columbus Federal Savings Bank, Beneficiary, assigned all of its
<br /> right, title and beneficial interest in the Deed of Trust to Commercial Federal �Vlortgage Corporation.
<br /> The Assignment was recorded November 13, 1995, in the office of the Register of Deeds of Hall County,
<br /> Nebraska, as Instrument No. 95-107759.
<br /> Hereinafter the Trustee, Commercial Federal Bank, a Federal Savings Bank, will be referred to
<br /> as iRANTOR.
<br /> The GRANTOR in consideration of Forty-Two Thousand Eight Hundred Fifty-Four pollars
<br /> and Twelve Cents ($42,854.12) and other valuable consideration received from Commercial Federal
<br /> Mortgage Corporation, hereinafter GRANTEE, does hereby grant, bargain, sell, convey and confirm
<br /> unto GRANTEE the following described real property in Hall C�unty, Nebraska:
<br /> The Easterly 36.6 feet (being all that part which lies East of the center line of the
<br /> driveway now on said premises) of Fractional Lot 3, Block 22, Nagy's Addition, City
<br /> of Grand Island, Hall County, Nebraska, and its complement, being that part of an
<br /> irregular parcel of ground situated in that part of the SW1/4 SWl/4 of Section 10,
<br /> Township 11 North, Range 9 West of the 6th P.M., Hall County, Nebraska, known as
<br /> Nagy's reserve, which also lies East of the center line of the driveway
<br /> To have and to hold the above-described premises together with all tenements, hereditaments and
<br /> appurtenances thereto belonging unto the GRANTEE, and to GRANTEE'S successors and assigns
<br /> forever.
<br /> GRANTOR does hereby covenant with the GRANTEE and with the GRANTEE'S successors and
<br /> assigns:
<br /> (1) That Abelardo Zubia and Bobbi Jean King, both single persons, as Tr�stors, failed to pay
<br /> the Beneficiary payments which were contractually due, and the GRANTOR, at the request of the
<br /> Beneficiary, elected to declare the entire unpaid principal balance, together with interest thereon, at once
<br /> immed?ately du� ar.d payable.
<br /> (2) That a Notice of Default was recorded by GRANTOR on December 10, 1998, as
<br /> Instrument No.98-112157, in the records of the Register of Deeds, Hall County, Nebraska. Within ten
<br /> (10) days thereafter, a copy of the recorded Notice of Default was mailed by certified mail, postage
<br /> prepaid, to all parties entitled to notice, pursuant to said Deed of Trust and in compliance with Neb. Rev.
<br /> Stat. § 76-1008 (Reissue 1996).
