MAYNARD H. WEINBERG, being first duly sworn, deposes and states those facts of
<br />which he has personal knowledge as set forth hereinbelow:
<br />1. That Affiant is a licensed attorney authorized to practice law in the State of
<br />Nebraska.
<br />2. That Affiant was the attorney of record for the Personal Representative of the
<br />Estate of Nettie L. England, which proceedings were filed with the Hall County, Nebraska
<br />County Court as Case No. 38 -167.
<br />3. That Nettie L. England was the owner of record of an undivided one -half (1/2)
<br />interest in the following described real estate at the time of her death on December 1, 1980, to-
<br />wit:
<br />The Southeast Quarter (SE' /4) of Section Twenty -One (21) and the
<br />Southwest Quarter (SW' /4) of Section Twenty -Two (22), both in
<br />Township Nine (9) North, Range Nine (9) West of the 6th P.M.,
<br />Hall County, Nebraska,
<br />which real estate appears as Item 2 on Schedule A of the Inventory of the assets of the Decedent
<br />filed in the aforereferenced estate proceedings.
<br />4. That pursuant to article THIRD paragraph (b) of the Last Will and Testament of
<br />Nettie L. England dated September 18, 1980, the Decedent Nettie L. England bequeathed her
<br />one -half (1/2) interest in the aforedescribed real estate to England Farms, Inc.
<br />5. That the Personal Representative, due to inadvertence and oversight, failed to file
<br />with the Hall County Register of Deeds a Deed of Distribution conveying the aforedescribed real
<br />estate to England Farms, Inc.
<br />6. That in accordance with the laws of the State of Nebraska and notwithstanding the
<br />failure of the Personal Representative to record a Deed of Distribution upon the death of the
<br />Decedent Nettie L. England, the Decedent's one -half (1/2) interest in the aforedescribed real
