202604570 6.10 WAIVER OF JURY TRIAL. THE AGENT AND THE GRANTOR HEREBY WAIVE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING BASED UPON, OR RELATED TO, THE SUBJECT MATTER OF THIS DEED OF TRUST. THIS WAIVER IS KNOWINGLY, INTENTIONALLY, AND VOLUNTARILY MADE BY THE AGENT AND THE GRANTOR, AND THE AGENT AND THE GRANTOR ACKNOWLEDGE THAT NO PERSON ACTING ON BEHALF OF ANOTHER PARTY TO THIS AGREEMENT HAS MADE ANY REPRESENTATIONS OF FACT TO INDUCE THIS WAIVER OF TRIAL BY JURY OR IN ANY WAY TO MODIFY OR NULLIFY ITS EFFECT. THE AGENT AND THE GRANTOR FURTHER ACKNOWLEDGE THAT THEY HAVE BEEN REPRESENTED (OR HAVE HAD THE OPPORTUNITY TO BE REPRESENTED) IN THE SIGNING OF THIS DEED OF TRUST AND IN THE MAKING OF THIS WAIVER BY INDEPENDENT LEGAL COUNSEL, SELECTED OF THEIR OWN FREE WILL, AND THAT THEY HAVE HAD THE OPPORTUNITY TO DISCUSS THIS WAIVER WITH COUNSEL. 6.11 Request for Notice. The Grantor requests a copy of any statutory notice of default and a copy of any statutory notice of sale hereunder be mailed to the Grantor at the address specified in the preamble of this Deed of Trust in accordance with Section 6.3 of this Deed of Trust. 6.12 Reconveyance by Trustee. Pursuant to Neb. Rev. Stat. § 76-1014.01, when the Indebtedness secured by this Deed of Trust has been satisfied, the Agent shall, upon written request by the Grantor, deliver to the Grantor or the Grantor's successors -in -interest or representatives, a reconveyance in recordable form duly executed by Trustee. The reconveyance may designate the grantee of such reconveyance as the person or persons entitled thereto. The recitals in such reconveyance of any matters or facts shall be conclusive proof of the truthfulness thereof, absent manifest error. 6.13 Security Interests in Rents. This Deed of Trust shall constitute a security interest in the Rents and Profits, including all future or after arising rents and leases, and shall secure the Indebtedness, all as provided in Neb.
