Said Deed of Trust was recorded in the Office of the <br /> Register of Deeds of Hall County, Nebraska, on April 3, 1997, as Document No. 97- <br /> 102403. Further, United Nebraska Bank is the Trustee under a Deed of Trust made <br /> and entered into on or about October 30, 1997, by and between C & C Homes, Inc., <br /> a Nebraska corporation, Trustor, and United Nebraska Bank, Trustee and Beneficiary. <br /> Said Deed of Trust was recorded in the Office of the Register of Deeds of Hall <br /> County, Nebraska, on October 31 , 1997, as Document No. 97-109151 . United <br /> Nebraska Bank, Grantor, in consideration of the sum of One Hundred Fifty-five <br /> Thousand Dollars ($155,000.00) and other good and valuable consideration received <br /> from UNITED NEBRASKA BANK, does hereby grant, bargain, sell, convey, and <br /> confirm unto UNITED NEBRASKA BANK, (hereafter Grantee), the following described <br /> real property located in Grand Island, Hall County, Nebraska, to-wit: <br /> Lot Five (5), Block Two (2), Ponderosa Lake Estates Third Subdivision, <br /> an Addition to the City of Grand Island, Hall County, Nebraska. <br /> TO HAVE AND TO HOLD the above-described premises, together with all <br /> tenements, hereditaments, and appurtenances thereunto belonging, unto the Grantee <br /> and to Grantee's successors and assigns forever. Grantor does hereby covenant with <br /> Grantee and Grantee's successors and assigns: <br /> 1 . That C & C Homes, Inc., a Nebraska corporation, failed to pay to Beneficiary <br /> payments which were contractually due, and the Grantor, at the request of the <br /> Beneficiary, elected to declare the entire unpaid principal balance, together <br /> with interest thereon, at once immediately due and payable. <br /> 2. That a Notice of Default, as required by §76-1006, was recorded by Grantor <br /> on October 9, 1998, as Document No. 98-109951 , in the Office of the <br /> Register of Deeds of Hall County, Nebraska. A copy of said Notice of Default <br /> was thereafter mailed to all parties entitled to notice pursuant to said Deed of <br /> Trust and in compliance with §76-1008, R.R.S. Neb. <br /> 3. That the Trustor failed to cure the default referenced in the Notice of Default <br /> within thirty (30) days after filing of the Notice of Default. <br /> 4. That a Notice of Trustee's Sale of the time and place of the sale was thereafter <br /> mailed to all parties entitled to notice pursuant to said Deed of Trust and in <br /> compliance with §76-1008, R.R.S. Neb. <br /> 5. That Grantor, as required by §76-1007 published Notice of Trustee's Sale to <br /> be held on December 30, 1998, at 10:00 a.m., at the Hall County Courthouse; <br /> Grand Island, Nebraska. Said notice was published in The Grand Island Dailv <br /> IndeRendent, a legal newspaper of Grand Island, Hall County, Nebraska, once <br />
