NOTICE OF SUIT
<br />NOTICE IS HEREBY GIVEN that on the day of February, 2004, LaSalle Bank National
<br />Association as Trustee for Certificateholders of Bear Stearns Asset Backed Securities, Inc., Series 2001 -3,
<br />as plaintiff, filed its Complaint in the District Court of Hall County, Nebraska, against Bonifacio Jacobo
<br />Lopez, Francisca Alcantar, Jerry J. Milner, Trustee, and Associates Financial Services Company, Inc., as
<br />defendants, the object and prayer of such Complaint being to obtain an accounting, to foreclose a deed of
<br />trust given by said Bonifacio Jacobo Lopez, a married person, and Francisca Alcantar, a married person, to
<br />ATI Title, as Trustee, for the benefit of First Union National Bank of Delaware, Beneficiary, to foreclose
<br />any interest in or lien upon the real estate hereinafter described of the above -named defendants, to obtain
<br />an order for the sale of the real estate hereinafter described for the satisfaction of the indebtedness secured
<br />by such deed of trust and to obtain other equitable relief; that such deed of trust is dated October 20, 2000
<br />and was recorded October 30, 2000, as Instrument Number 200009377 of the Mortgage Records of Hall
<br />County, Nebraska, and conveyed to such beneficiary the following described real estate situated in Hall
<br />County, Nebraska, to -wit:
<br />LOTS 9 AND 10, BLOCK 65, IN WHEELER AND BENNET'S ADDITION TO
<br />THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA;
<br />that such deed of trust was sold, transferred, and assigned to EMC Mortgage Corporation by written
<br />assignment recorded on December 3, 2001, as Instrument Number 200112352 of the Mortgage Records of
<br />Hall County, Nebraska; and that such deed of trust was sold, transferred, and assigned to the plaintiff by
<br />written assignment recorded on January 30, 2004, as Instrument Number 0200400885 of the Mortgage
<br />Records of Hall County, Nebraska.
