202602716 <br />1 <br />RESOLUTION 2026-108 <br />WHEREAS, public right-of-way is required by the City of Grand Island for State <br />Street/Diers Avenue Improvements; Project No. 2026-P-1, from property described as follows: <br />Property Owner <br />Legal Description <br />Amount <br />Grand Island Joint <br />Venture, LLC <br />A PERMANENT UTILITY EASEMENT LOCATED IN PART OF <br />LOT 6, GRAND ISLAND MALL EIGHTH SUBDIVISION, IN THE <br />CITY OF GRAND ISLAND, NEBRASKA, AND MORE <br />PARTICULARLY DESCRIBED AS FOLLOWS: <br />COMMENCING AT THE SOUTHWEST CORNER OF LOT 6, <br />GRAND ISLAND MALL EIGHTH SUBDIVISION, THENCE ON <br />AN ASSUMED BEARING OF N00°33'23"W, ON THE WEST LINE <br />OF SAID LOT 6, A DISTANCE OF 10.42 FEET; THENCE <br />CONTINUING NOO°33'23"W, ON SAID WEST LINE, A <br />DISTANCE OF 27.96 FEET; THENCE N45°06'22"E A DISTANCE <br />OF 76.76 FEET TO THE EAST LINE OF SAID LOT 6; THENCE <br />SOO°33'23"E, ON SAID EAST LINE OF LOT 6, A DISTANCE OF <br />27.96 FEET; THENCE S45°06'22"W A DISTANCE OF 76.76 TO <br />THE POINT OF BEGINNING, SAID PERMANENT UTILITY <br />EASEMENT CONTAINS A CALCULATED AREA OF 1535.16 <br />SQUARE FEET OR 0.035 ACRES MORE OR LESS. <br />$5,952.00 <br />Total= $5,952.00 <br />WHEREAS, agreement for the permanent utility easement has been reviewed and <br />approved by the City Legal Department. <br />NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF <br />THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, <br />authorized to enter into the Agreement for permanent utility easement on the above described tract of <br />land. <br />BE IT FURTHER RESOLVED, that the Mayor is hereby authorized and directed to <br />execute such agreement on behalf of the City of Grand Island. <br />Adopted by the City Council of the City of Grand Island, Nebraska, April 28, 2026. <br />Attest: <br />eL <br />Ji Granere, City Clerk <br />Rog G.
