DED <br />HALL G :r..�'� NE <br />nib tI'=t I u 9* 29 <br />YYuLD <br />REGISTER OF DEEDS <br />DO NOT WRITE ABOVE THIS LINE - FOR REGISTER OF DEEDS USE ONLY <br />SOUTHERN PUBLIC POWER DISTRICT <br />ELECTRIC UTILITY RIGHT-OF-WAY EASEMENT <br />KNOW ALL MEN BY THESE PRESENTS, that the undersigned Andrew Woitaszewski, and their successors or <br />assigns, collectively "Grantor", for and in consideration of the amount set forth in this easement, does hereby grant <br />unto Southern Public Power District and its successors or assigns, collectively "Grantee"; a utility easement upon <br />the lands of the Grantor, situated in the County of Hall , State of Nebraska and more particularly described as <br />follows: <br />SEE EXHIBIT "A" ATTACHED HERE TO AND BY THIS REFERENCE MADE A PART HEREOF <br />Grantor hereby grants the right to construct, operate, repair, maintain, relocate, and replace electric utility line <br />facilities, together with the necessary appurtenances, in, over, and upon the above -described easement, along with <br />rights of ingress and egress. <br />The Grantor shall maintain all other rights of possession, including rights of ingress and egress over the easement <br />properties described above. <br />The Grantor shall not construct any buildings, structures, signs, or light poles, or plant any trees or shrubbery, over <br />or on said easement area without the prior express written consent of the Grantee. <br />Compensation for this easement shall be in the amount of $1.00, receipt of which is hereby acknowledged. <br />/6, <br />The undersigned covenants that he is the owner of the above -described lands and that the said lands are free and <br />clear of encumbrances and liens of whatsoever character except covenants, conditions, easements, and restrictions of <br />record. <br />It is further understood that, whenever necessary, words used in this instrument in the singular shall be construed to <br />read in the plural and that words used in the masculine gender shall be construed to read in the feminine. <br />IN WITNESS WHEREOF, Grantor has set his hand this 15 day of ___Ag rt 1 , 2Q <br />STATE OF 1 e braska, <br />COUNTY OF Hail <br />On this 5 day of A p r i , 20 o'i(o , before me, a notary public duly commissioned <br />and qualified for and in said county, personally came Andrew Woitaszewski to me known to be the identical <br />person(s) whose name(s) is/are affixed to the foregoing instrument, is Grantor and acknowledged the same to be his <br />voluntary act and deed. <br />Witness my hand and seal the day and year last above written.
