Robb ("Robb") as the developer and the <br />Village of Doniphan, Hall County, Nebraska ("Village"). <br />WHEREAS, there has caused to be platted, filed and approved with the Regional <br />Planning Commission for Hall County, Nebraska, that parcel of land hereinafter described to be <br />know as Highpoint Development, LLC, First Subdivision, an Addition to the Village of <br />Doniphan, Hall County, Nebraska; and <br />WHEREAS, the Parties hereto seek to establish an understanding associated with the <br />development of said subdivision; <br />NOW THEREFORE in consideration of the mutual covenants herein contained, the <br />Parties agree as follows: <br />1. Robb is the owner of a tract of land referred to as Highpoint Development LLC, First <br />Subdivision to the Village of Doniphan, Hall County, Nebraska, and legally described as: <br />A tract of land consisting of a part of the Southeast Quarter of the Northease Quarter <br />(SE 1 /4NE 1 /4) of Section One (1), Township Nine (9) North, Range Ten (10) West of the <br />6th P.M., Hall County, Nebraska and more particularly described as follows: <br />Commencing at the Northeast corner of Lot One (1), Crane View Second Subdivision, <br />said point being on the west right of way line of U.S. Highway 281 and also being the <br />point of beginning, thence S89E41'29"W, on the North line of said Lot One (1), Crane <br />View Second Subdivision, a distance of 228.00 feet to the Northwest corner of said Lot <br />One (1), Crane View Second Subdivision; thence S00E31'21"W on the West line of said <br />Lot One (1), a distance of 227.99 feet to a point on the North right-of-way line of Clarice <br />Street an also being the Southwest corner of said Lot One (1), Crane View Second <br />Subdivision, thence S89E39'02"W, on said North right-of-way line, a distance of 117.11 <br />feet; S89E34'24"W a distance of 252.90 feet; thence N00E31'21 "E a distance of 150.23 <br />feet; thence N89E37'45"E a distance of 150.00 feet; thence N00E21'21 "E a distance of <br />600.00 feet; thence N89E37'45"E a distance of 220.00 feet; thence S00E31'21"W a <br />distance of 122.28 feet; thence N89E37'45"E a distance of 228.00 feet to the West line of <br />US Highway 281; thence S00E31'21"W, on said West line, a distance of 400.00 feet to <br />the Point of Beginnin Said tract contains a calculated area of 278667.54 square feet or <br />6.397 acres more or less of which 1.205 acres is new dedicated road right-of-way. <br />
