ORDINANCE NO. 10,060 (Cont.) <br />2026.00327 <br />1 <br />COMMENCING AT THE SOUTHWEST CORNER OF JBA MAIN SUBDIVISION WHICH IS <br />THE ACTUAL POINT OF BEGINNING, THENCE ALONG THE NORTH RIGHT OF WAY <br />LINE OF OLD POTASH HIGHWAY ON A BEARING OF N 89°13'19" W, A DISTANCE OF <br />25.00' FEET; THENCE N 00°05'37" W, A DISTANCE OF 479.30; THENCE S 89°13'19" E, A <br />DISTANCE OF 25.00' FEET TO THE NORTHWEST CORNER OF JBA MAIN SUBDIVISION; <br />THENCE S 00°05'37"E, ALONG THE WEST LINE OF JBA MAIN SUBDIVISION TO THE <br />POINT OF BEGINNING, SUCH TRACT CONTAINS 0.275 ACRES MORE OR LESS. <br />SECTION 4. The purchase price is ELEVEN THOUGHSAND NINE HUNDRED <br />EIGHTY-TWO AND 50/100 DOLLARS ($11,982.50). <br />SECTION 5. The Buyer shall be entitled to full possession of the Property at Clos- <br />ing. The Closing shall occur as soon as practicable after approval of sale by the City Council for <br />Grand Island, Nebraska. <br />SECTION 6. The Buyer shall assume all real estate taxes assessed against the <br />Property for the year 2026 and all subsequent years. <br />SECTION 7. At closing the following shall occur: <br />(a) The Seller shall deliver to the Buyer a fully executed warranty deed to be <br />prepared by the Buyer for Seller's execution. <br />(b) The Buyer shall pay to the Seller the Purchase Price. <br />(c) The Buyer shall prepare for recording any necessary easements and shall <br />record the same simultaneously with the deed. <br />SECTION 8. Subsequent to the closing, Buyer and Seller shall cooperate with <br />Seller, at Buyer's expense, converting the public sewer line on the property to a private line, and <br />the removal of existing power lines on the Property and replacement of the same at a location <br />determined to be most suitable to Seller. Buyer shall reasonably consult Seller prior to the <br />construction by Buyer of any fencing along the western boundary of the Property. The Easements <br />listed in 7(c) shall serve to operate until such time as said conversion and replacement can be <br />facilitated. Seller agrees to cooperate with the Buyer in vacating said easements once no longer <br />necessary. <br />SECTION 9. As provided by law, notice of such conveyance and the terms thereof <br />shall be published for three (3) consecutive weeks in the Grand Island Independent, a newspaper <br />published for general circulation in the City of Grand Island. Immediately after the passage and <br />publication of this ordinance, the City Clerk is hereby directed and instructed to prepare and <br />publish said notice. <br />2 <br />
