202600O53 1 RESOLUTION 2025-434 WHEREAS, a public utility easement is required by the City of Grand Island for Northwestern Energy to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities; and WHEREAS, the City of Grand Island is both the owner of the subject property and the grantor of the public utility easement; and, WHEREAS, whether the public, by and through the City of Grand Island as property owner, should record an easement for the benefit of public utilities, came on before Council for consideration on December 30, 2025, for the purpose of discussing the proposed recording of a forty-seven (47.0) foot wide utility easement tract in part of Detention Cell Lot C Platte Valley Industrial Park Third Subdivision, to the public; the boundary of the public utility easement and right-of-way tract being more particularly described as follows: A 47-foot-wide public utility easement located in part of Detention Cell lot C, Platte Valley Industrial Park Third Subdivision, in the City of Grand Island, Hall County, Nebraska and more particularly described as follows: being the south 47 feet of Detention Cell lot C. The above -described public utility easement contains a calculated area of 11,737.25 square feet more or less, as shown on the plat dated 10/01/2025, marked Exhibit "A" and attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that a public utility easement be recorded by City of Grand Island on, over and below the tract of land described herein and as depicted on Exhibit A for the use of Northwestern Energy and other public utility companies or private utility companies performing work as may be authorized by law or agreement from time to time. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
