DEED OF TRUST MODIFICATION AGREEMENT <br />(Variable Rate to Fixed) <br />THIS DEED OF TRUST MODIFICATION AGREEMENT made and executed this <br />16th day of November , 2001, by and between James F. Harrie , hereinafter referred to as <br />"Borrower ", and HOME FEDERAL SAVINGS AND LOAN ASSOCIATION OF GRAND s <br />ISLAND, hereinafter referred to as "lender ", <br />G <br />WITNESSETH: <br />WHEREAS, Borrower did execute a certain Adjustable Rate Note payable to the order of <br />the Lender in the total original amount of Forty Two Thousand Five Hundred Dollars and <br />00 /100 , Dollars ($42 500.00 ; <br />WHEREAS, the Note described above was secured by a Deed of Trust with Adjustable <br />Rate Rider dated January 24 , 1994, filed of record in the Office of the Hall County Register <br />of Deeds on January 31st , 1994, as Document No. 94- 100869 in respect to that real estate <br />described as: <br />LOT SEVEN (7), IN BLOCK TWENTY -SEVEN (27), IN CHARLES WASMER' S <br />ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA. <br />WHEREAS, Borrower has requested that interest be converted to a fixed rate <br />rather than the variable rate specified by such Deed of Trust with Adjustable Rate Rider and that <br />the stated maturity date be also hereby modified; <br />WHEREAS, Lender is willing to convert such variable rate loan into a fixed rate loan to <br />be secured by such Deed of Trust with Adjustable Rate Rider and modify the existing maturity <br />date; <br />WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust <br />with Adjustable Rate Rider identified hereinabove to provide that it shall continue to secure the <br />presently remaining indebtedness from and after the date hereinafter specified together with a <br />A <br />CD <br />CTa <br />Cs <br />Q* <br />V-*- <br />CD <br />ca <br />a <br />a ti <br />M <br />Z D <br />3. <br />M <br />rn <br />Qcz� <br />c <br />N <br />CD <br />-< rn <br />-) o <br />p 'n <br />W <br />r .Z7 <br />n <br />O <br />O <br />O <br />N <br />o <br />� <br />w <br />DEED OF TRUST MODIFICATION AGREEMENT <br />(Variable Rate to Fixed) <br />THIS DEED OF TRUST MODIFICATION AGREEMENT made and executed this <br />16th day of November , 2001, by and between James F.
