Jones and Michelle L. Jones <br />TRUSTEE: Mac America Ag Finance, Inc. <br />LENDER: Mac America Ag Finance, Inc. <br />CONSIDERATION: Sale of Real Estate — Balance Due: $680,000.00 <br />acknowledge, waive, and disclaim as follows: <br />The undersigned understand that as Borrower the undersigned may have a right to claim the real estate <br />described in the Deed of Trust, or a part thereof, as homestead, or at some time in the future may designate <br />the property or a part thereof as homestead. The undersigned hereby waive any right to make a designation <br />of homestead in the property or any part thereof, and disclaim designation of homestead in the property or <br />any part thereof, and disclaim any right to make a designation of homestead in the future in the property or <br />any part thereof so long as the Deed of Trust remains a lien on the property. <br />2. The undersigned understand that by signing this document they will not have rights which would otherwise <br />be available to them which may allow them to retain a homestead in the event that they default in the <br />performance of the terms and provisions of the Deed of Trust. <br />3. Signing this document is the undersigneds' voluntary act and deed, and is intended to be a written, <br />knowing, and voluntary waiver of any right that they may have at this time to a homestead in the property <br />or any part thereof, and is a voluntary disclaimer of any right which they may have in the future to <br />designate the trust property or any part thereof as homestead, all as provided by the Nebraska Farm <br />Homestead Protection Act. <br />4. The undersigned further acknowledge that they have read and signed this document prior to the signing of <br />the Deed of Trust above -identified, and understand and intend that this instrument may be filed as a preface <br />to the Deed of Trust above -identified, all of which will be filed in the Real Property Records of the Hall <br />County Register of Deeds. <br />5.
