Goveming Law. This Second Deed of Trust shall be governed by and construed i� accordance with the laws of the State of Nebraska. In the event ihat any provisiun or clause of any of the Loan Insuuments conflicts with applicable laws,such conflict shall not atfect other provisians of such Lean Instrume�ts which can be given effect without ihe contlicting provision. and to this end the provisians of ihe Laa� InsVuments are declared to be severabla. This instrument cannot be waived, chanqed, discharqed or terminated orally, but only by an insVument in writing signed by the party against whom enforcement of any waiver, change, discharge or termination is seught. 15. Reconveyance by Trrrstas. Upon written request of Beneficiary stating that all sums secured hereby have been paid and upo� surrender of this Second Deed of Trust and any note ta Trustee for cancellation and retention and upon payment by Trusto�of Trustee's fees,Trustee shall reco�vey to Trusto�, or the person ar persons leqally enatled thereto, without warranry, any partion of the Trust Esiate then held hereunder. The recitals in such reconveyance of any matters or facts shall be conctusive proof of the truthfulness thereof. The grantee in any recanveyance may be described as"the person or persons legally entitled thereto.' 16. Nodcas. Whenever Beneficiary, Trustor or Trustee shall desi�e ta give or serve any notice, demand, �equest or other communicatian with respect to this Secand Deed of Trust, each such notice, demand, request ar other communication shall� be in writing and shall be effective only if the same is delivered by personal service or mailed by certified mail, postage prepaid, return receipt requesied, addressed to the address set forch at the beginning of this Second Deed of Trust. Any parry may at any time change its address for such notices by delivering or mailing to the ather parcies hereto, as aforesaid, a nodce of such change. 17. Acceptance by Trrrstae. Trustee accepts this Trust when this Second Deed of Trust, duly executed and acknawledged, is made a public record as provided by law. a � 4
