202506863 <br />4. Sanitary Sewer. Each lot shall be served by individual on site waste -water <br />treatment systems as approved and governed by the State of Nebraska. The Subdivider waives the <br />right to protest the creation, expansion, modification, or correction of any future sanitary sewer <br />district within or abutting the subdivision. <br />5. Storm Drainage. The Subdivider agrees to grade all lots in the subdivision in <br />conjunction with the development proposed thereon so that storm drainage is conveyed to a public <br />right-of-way or to other drainage systems. The Subdivider shall maintain and preserve historic <br />drainage from and across the property. Development shall be limited to minimize changes to historic <br />drainage. If the Subdivider fails to grade and maintain such drainage the County may create a <br />drainage district to perform such work. The Subdivider agrees to waive the right to object to the <br />creation of any drainage district benefitting the subdivision. <br />8. Design and Construction. No building shall be constructed within the <br />Subdivision except within the building envelope on each lot (approximately 10000 sq. ft). as shown <br />on each lot on the development plan. Building envelopes may be adjusted on the property but shall <br />not exceed 10000 square feet in a 100 foot by 100 foot rectangle on the lot. <br />9. Flood Plain Since the subdivision is within a flood plain as delineated from <br />the best information available from the Federal Emergency Management Agency Flood Maps, all <br />structures impacted by said floodplain constructed shall have the lowest floor elevation to a <br />minimum of one foot above the elevation of the 100-year flood as determined by the building permit <br />received by the Subdivider or successors from the County Building Department. No basement shall <br />be constructed in connection with any structure in the flood plain unless such basement is <br />floodproofed and certified as such by a qualified engineer or architect. <br />SYCAMORES AT PRAIRIE CREEK Subdivision Agreement Page 3 <br />
