Subdivision, Hall County, Nebraska. <br />CERTIFICATION OF TRUST <br />ROBERT R. RATHMAN and LEONARD R. RATHMAN being first duly sworn upon <br />oath, depose and state that: <br />1. On September 13, 2005, Rodney R. Rathman ("Grantor" or "Settlor") executed <br />that certain Rodney R. Rathman Revocable Living Trust Agreement dated September 13, 2005 <br />(the "Rodney R. Rathman Trust") wherein he designated Phyllis I. Rathman as initial Trustee; <br />2. Rodney R. Rathman died on April 20, 2008; <br />3. Upon the death of Rodney R. Rathman and pursuant to ARTICLE VIII, Paragraph <br />B.2. of the Rodney R. Rathman Trust, Settlor Rodney R. Rathman provided that upon the <br />settlement of his Trust a separate Trust to be known as the Rodney R. Rathman Family Trust (the <br />"Rodney R. Rathman Family Trust") was to be created and funded; <br />4. On July 1, 2025, Phyllis I. Rathman was determined to be incapacitated and unable to <br />continue to serve as Trustee of the Rodney R. Rathman Fancily Trust due to her advanced age <br />and deteriorating health condition. Due to the incapacity of Phyllis I. Rathman and pursuant to <br />the terms of the trust agreement, ROBERT R. RATHMAN and LEONARD R. RATHMAN <br />hereby accept the successor Co -Trusteeship of the Rodney R.. Rathman Family Trust, accept the <br />duties of said office and agree to administer said Rodney R. Rathman Family Trust in accordance <br />with the terms of said trust agreement and the laws of the State of Nebraska; <br />5. The Trust is irrevocable due to the death of the decedent, Rodney R.
