202506379 <br />Public Sanitary Sewer Connection Agreement <br />This Public Sanitary Sewer Connection Agreement is made by and between the CITY OF GRAND ISLAND, NEBRASKA, <br />a municipal Corporation, herein referred to as the "City" and TERRAZAS/ELIAS & KARINA, Owner, hereinafter referred to <br />as the "Owner", <br />WITNESSETH: <br />WHEREAS, the Owner desires to connect property to a public sanitary sewer main as follows: <br />LOT ONE (1), TERRAZAS SUBDIVISION IN THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA <br />WHEREAS, the City will permit sanitary sewer lines to connect directly to the public sanitary sewer main, subject to <br />certain conditions being met by the Owner. <br />NOW, THEREFORE, in consideration of the covenants and agreements hereinafter contained, the parties agree <br />as follows: <br />1. The City hereby grants to the Owner a permit to connect the property at 723 GEDDES ST to the City's sanitary <br />sewer, Plumber must follow the detail of connection as discussed with Public Works Director to The City hereby grants to <br />the Owner a permit to connect the property at 723 GEDDES ST to the City's sanitary sewer, <br />Plumber must follow the detail of connection as discussed with Public Works Director to install a tee and a cleanout to the <br />eight ( 8) inch stub from Manhole No. 170.. Licensed plumber must also obtain a Sanitary Sewer Tap permit from <br />Public Works Administration., as shown on the attached drawing dated September 02, 2025, in accordance with the City <br />Plumbing Code and the requirements of the Director of Public Works. Such connection is to be inspected and approved by <br />the Public Works Director, or their designee. <br />2. The private extension to the existing sanitary sewer main shall be constructed and maintained by the Owner and <br />shall remain the property of the Owner, and in no event shall the City be required to maintain the line. Often the private <br />sanitary sewer Tine extends outside of the property line. <br />3. It the construction or maintenance of the Owner's private sanitary sewer service line and connecting to the City's <br />main line requires the excavation of dirt, removal of hard surfacing, grass, vegetation, landscaping, or any other disruption <br />of the surface of the public right-of-way or any other property, the Owner shall restore the surface of the area to the <br />same condition as it existed immediately prior to the Owner's work in the area. The Owner shall obtain all necessary <br />permits and comply with the City requirements for excavations and surfacing when doing any such work in the public right- <br />of-way. <br />4. Upon connection to the public main, the entire private line installation, repair, and maintenance is the responsibility of the <br />Owner. All repairs and maintenance on the private line are the responsibility of the Owner. <br />5. It is understood by the Owner that the connection fee is $584.50 payable to the City of Grand Island prior to connection. <br />The City of Grand Island hereby acknowledges payment of said connection fee. It is further understood by the Owner that <br />all plumber's fees and sewer connection permit fees are at the Owner's own expense. Sanitary Sewer Connection permit <br />will only be issued to a licensed plumber. <br />5. The Owner hereby waives the right to protest the creation of a sanitary sewer district to serve this area. <br />7. It is understood by and between the parties that if a future sanitary sewer district is constructed to serve this area <br />they will share equitably in the cost of such. <br />8. It is understood and agreed that the Owner can construct, maintain, and connect their private sanitary sewer service <br />line to the City's sanitary sewer main at their own risk. The Owner hereby waives any claim for damages against the City, <br />its officers, agents, employees, and independent contractors for any damage or injury that may result to said private <br />line being connected to the City's sanitary sewer main in the public right-of-way. The Owner agrees to remove the private <br />line <br />connection at any such time as removal is necessary in order for the City to provide public services in the area, such <br />as installation, repair, or maintenance of utilities in the public right-of-way. <br />9. The Owner shall indemnify and hold harmless the City from and against any and all loss and damage, claims, <br />demands, suits, liabilities, and payments in contract or tort resulting from or as a result of the Owner's use of the sanitary <br />sewer main in the public right-of-way for the connection of a private sanitary sewer. <br />10. The Public Sanitary Sewer Connection Agreement shall take effect immediately upon the date of the execution of <br />this document by both parties and shall continue for an indefinite term; provided that either party may terminate this <br />
