202506369 <br />FIRST AMENDMENT <br />TO <br />DECLARATION OF RESTRICTIVE COVENANTS, RESTRICTIONS AND CONDITIONS <br />FOR <br />LAKE HERITAGE SUBDIVISION AN ADDITION TO THE CITY OF GRAND ISLAND, <br />NEBRASKA <br />AND <br />LAKE HERITAGE SECOND SUBDIVISION AN ADDITION TO THE CITY OF GRAND <br />ISLAND, NEBRASKA <br />WHEREAS, a certain Declaration of Restrictive Covenants, Restrictions and Conditions <br />for Lake Heritage Subdivision, an addition to the City of Grand Island and Nebraska and Lake <br />Heritage Second Subdivision, an addition to the City of Grand Island, Nebraska dated May 18, <br />2011 was filed in the Office of the Hall County, Nebraska Register of Deeds on December 12, <br />2011 as Instrument No. 201109314 (the "Restrictive Covenants") and indexed against the <br />following described real estate (collectively, the "Subject Property"): <br />Lot One (1), Lake Heritage Subdivision, an addition to the City of Grand Island, <br />Nebraska, along with any subsequent resubdivision thereof; and <br />Lots One (1), Two (2), Three (3), Four (4), Five (5) and Outlot A in Lake <br />Heritage Second Subdivision, an addition to the City of Grand Island, Nebraska, along <br />with any subsequent resubdivision thereof. <br />WHEREAS, pursuant to Article VI of the Restrictive Covenants, the Restrictive <br />Covenants may be amended at any time by an instrument signed by the then Owners of a <br />majority of the lots that comprise the Subject Property. As such, the Owners of a majority of the <br />lots that comprise the Subject Property must approve this Amendment for said Amendment to be <br />effective; <br />WHEREAS, the Owners of a majority of the lots that comprise the Subject Property <br />desire to have the following definition become subject to the Restrictive Covenants: <br />(a) "Association" shall mean the homeowners' association to be <br />formed by the Declarant to be known as "Lake Heritage of Grand Island <br />Homeowners Association" and its successors and assigns. <br />hereinafter collectively referred to as the "Association"; and <br />WHEREAS, the Owners of the Association desire to have the Association become <br />subject to the Restrictive Covenants. <br />NOW, THEREFORE, it is agreed as follows: <br />1. The recitals appearing hereinabove are hereby specifically incorporated herein <br />and made a binding part of this Amendment by this reference. <br />2. Article I of the Restrictive Covenants shall hereinafter appear and read as follows: <br />
