<br />KNOW ALL MEN BY THESE PRESENTS, that the undersigned Platte River Whooping Crane Maintenance
<br />Trust, Inc., and their successors or assigns, collectively "Grantor", for and in consideration of the amount set forth in
<br />this easement, does hereby grant unto Southern Public Power District and its successors or assigns, collectively
<br />"Grantee"; a utility easement upon the lands of the Grantor, situated in the County of Hall, State of Nebraska and
<br />more particularly described as follows:
<br />A strip of land being the Westerly forty-seven (47) feet of the Northerly one thousand one hundred fifty-five (1,155)
<br />feet of the Southwest Quarter (SW'/a) of Section Four (4), Township Nine (9) North, Range Ten (10) West of the
<br />Sixth Principal Meridian, Hall County, Nebraska, subject to existing road rights -of -way and easements of record.
<br />Grantor hereby grants the right to construct, operate, repair, maintain, relocate, and replace electric utility line
<br />facilities, together with the necessary appurtenances, in, over, and upon the above -described easement, along with
<br />rights of ingress and egress.
<br />The Grantor shall maintain all other rights of possession, including rights of ingress and egress over the easement
<br />properties described above.
<br />The Grantor shall not construct any buildings, structures, signs, or light poles, or plant any trees or shrubbery,
<br />over or on said easement area without the prior express written consent of the Grantee.
<br />Compensation for this easement shall be in the amount of $1.00, receipt of which is hereby acknowledged.
<br />The undersigned covenants that he is the owner of the above -described lands and that the said lands are free and
<br />clear of encumbrances and liens of whatsoever character except covenants, conditions, easements, and restrictions of
<br />record.
<br />It is further understood that, whenever necessary, words used in this instrument in the singular shall be construed to
<br />read in the plural and that words used in the masculine gender shall be construed to read in the feminine.
