If all �r any part of the property or interest is sold or transferred <br /> by Mortgagor, payment determined in accordance with paragraph 2 shall <br /> be immediately due and payable� excludings <br /> s. The creation of a lien or encumbrance subordinate to thie <br /> mortgage. <br /> b. The creation of a purchase money security interest in <br /> houaehold appliances. <br /> c. A transfer Uy devise. descent or by operation of law upon <br /> the death of a joint tenant. <br /> d. A tranefer by assumption. This mortgage may be transferred <br /> by aesumption if: <br /> i. The Mortgngor(e) has obtained consent in writing <br /> from the Mortgagee prior to tfansfer= <br /> ii. The sesumption purchaser has approval of the <br /> first mortgage holder or a new first mortgage is <br /> obtained by the purchaser; and <br /> iii. The assumption purchaser or new mortgagor will <br /> occupy the propertq covered by thia second . <br /> mortgage. <br /> 4. Should the Mortgagor enter into an agreement to rent or lease the <br /> propertq described above, the Mortgagee shall declare aIl suma <br /> secured by this mortgage to be immediately due and payable. The <br /> amount of sum due ahall be the amount as determiaed in accordance <br /> with paragraph 2. <br /> 5. Upon Mortgagor'8 breach of any covenent or agreement of Mortgagor in <br /> this mortgage, Mortgagee prior to acceleration, ehall mail notice to <br /> Mortgagor specifying: (1) the breach; (2) the action required to cure <br /> such breach; (3) a date� not less than 30 days from the date the <br /> notice is mailed Mortgagor. b}r which auch breach must be cured; and <br /> (4) the failure to cure such breach on or before the date apecified <br /> in the notice shall reault in acceleration of the sums secured by <br /> this mortgage� foreclosure by judicial proceedings and sale of the <br /> property. The notice shall further inform Mortgagor of the right to <br /> reinstate after acceleration and the right to assert in the <br /> foreclosure proceeding the non-existence of a ¢efault or any other <br /> defense of Mortgagor to acceleration and foreclosure. If the breach <br /> is not cured on or before the date epecified in the notice. Mortgagee <br /> shall declare all of the sums aecured by this mortgage to be <br /> immediately due and payable without further demand and may forecloae <br /> this mortgage. Mortgagee shall be entitled to collect in such <br /> proceeding all expensea of •foreclosure including but not limited to� � <br /> costs of documentary evidence� aUstracts and title reports. <br /> 2 <br /> I <br />
