CASH <br />CHECK 2 <br />R :FUNDS: <br />CASH <br />CHECK <br />ED <br />HALL CCUNTY NE <br />INST 7025 0 5` 5 9 205 eel A it: ] l <br />Return to: Robert Gehm / ,. <br />NorthWestern Energy' <br />3210 Douglas Avenue <br />Yankton, SD 57078 <br />GAS UTILITY EASEMENT <br />KNOW ALL MEN BY THESE PRESENTS: <br />KRIS li WOLD <br />REGISTER OF DEEDS <br />That JR3 Farm, L.L.C., a Nebraska limited liability company, the "Grantor", of Hall County, Nebraska, for <br />and in consideration of the sum of one dollar ($1.00) and other good and valuable consideration, the receipt of which <br />is hereby acknowledged, does hereby grant, remise, convey and relinquish unto NorthWestern Energy Public <br />Service Corporation, a South Dakota corporation, d/b/a NorthWestern Energy, the "Grantee", with its principal <br />operations office located at 600 Market Street West, Huron, South Dakota 57350, its successors or assigns, a gas <br />utility easement for the installation, maintenance and operation of an underground natural gas pipeline along with all <br />appurtenances thereto, over, under, upon and through the following described lands situated in the County of Hall, <br />State of Nebraska, to wit: <br />A 10-foot-wide tract of land located in part of the East Half of the Southwest Quarter (E1/2 <br />SW1/4) of Section One (1), Township Ten North (T10N), Range Ten West (R10W) of the 6th <br />Principal Meridian, Hall County, Nebraska, and more particularly described as follows: <br />Commencing at the Southwest (SW) corner of the E112 SW1/4 of Section 1; thence on an <br />assumed bearing of North 00°04'48" East, along the West line of said E112 SW114, a distance <br />of 40.00 feet to the Point of Beginning; thence continuing North 00°04'48" East, a distance of <br />10.00 feet; thence North 89°08'24" East, parallel to the South line of said E112 SW114, a <br />distance of 1363.28 feet to the East line of said E112 SW1/4; thence South 00°09'17" East, <br />along said East line, a distance of 10.00 feet; thence South 89°08'24" West, parallel to said <br />South line of said E1/2 SW1/4, a distance of 1363.32 feet to the Point of Beginning; as <br />illustrated in Exhibit "A" attached hereto. Said tract of land containing 0.313 acres, more or <br />less. <br />[The purpose of the above -described easement is for an underground natural gas pipeline <br />along with all appurtenances thereto (the "Facilities").] <br />TO HAVE AND TO HOLD unto said Grantee, its successors and assigns, so long as the Facilities shall be <br />maintained and operated, together with the right of ingress and egress from said premises for the purpose of <br />surveying, constructing, installing, inspecting, repairing, maintaining, renewing and replacing the property of the <br />Grantee located thereon, or removed thereof, in whole or in part, at the will of the Grantee. <br />
