Insurance proceeds shall be applied to restoration or repair of <br />the property damaged, unless both parties otherwise agree, except if restoration or <br />repair is not economically feasible or Lender's security is not lessened. Otherwise, <br />such proceeds shall be paid to Lender to satisfy the obligations of the Note and <br />secured herein, whether or not then due. Upon request, Borrower shall provide <br />Lender with proof that the insurance required by this paragraph is in force. <br />(b) Borrower agrees to properly care for and keep the Property in good order, <br />condition, and repair and to maintain any buildings and improvements on the <br />Property in good order, condition, and repair. Without the prior written consent of <br />Beneficiary, Trustor agrees not to cause or permit any building or improvement <br />which constitutes a part of the Premises to be removed, demolished, or structurally <br />altered, in whole or in part, or any fixture or piece of equipment which constitutes <br />a portion of the Property to be removed, damaged, or destroyed. Borrower agrees <br />not to cause or permit any waste to any building, improvement, fixture, or <br />equipment at any time that constitutes a portion of the Property. Borrower agrees <br />to complete, restore and reconstruct in a good and workmanlike manner to the <br />condition required hereby any improvement on the Premises which may be <br />damaged or destroyed; not to permit any lien of construction, mechanics or <br />materialmen to attach to the Property, to comply with all laws, ordinances, <br />regulations or governmental orders affecting the Property or requiring any <br />alterations or improvements thereto; and to do any other act or acts, all in a timely <br />and proper manner which from the character or use of the Property may be <br />reasonably necessary to protect and preserve the value of such property. <br />(c) Borrower agrees that, as to any alteration, addition, construction, or improvement <br />to be made upon the Property, all plans and specifications therefor shall be <br />approved in writing by Beneficiary prior to the commencement of work. Once <br />commenced, all work thereunder shall be prosecuted with due diligence, and all <br />construction thereof will be fully in accordance with the plans and specifications so <br />approved, and will comply with all laws, ordinances or regulations made or <br />promulgated by any governmental agency or other lawful authority. Should <br />Borrower at any time fail to comply with any governmental notice or demand <br />alleging a failure to comply with any such plan, specification, law, ordinance or <br />regulation, such failure shall, at Beneficiary's option, constitute an Event of Default <br />hereunder. <br />(d) Borrower hereby absolutely and unconditionally assigns to Trustee in trust for <br />Lender all of Borrower's right, title, and interest in and to all future leases and rents <br />for any portion of the Property; it being intended by Borrower that this assignment <br />constitutes a present, absolute assignment and not an assignment for additional <br />security only. Unless otherwise specified by the Beneficiary in writing, all existing <br />and future leases for the use or occupancy of all or any part of the Property shall be <br />subordinate and inferior to the lien of this Deed of Trust. <br />3 <br />
