<br />MORTGAGE EXTENSION AGREEMENT
<br />AGREEMENT made October 26, 2001, between BARRY W. NIEDFELT and
<br />JoLYNN NIEDFELT, Husband and Wife, of Grand Island, Hall County,
<br />Nebraska, herein referred to as "MORTGAGORS", and NORMAN B. BAHR,
<br />of Grand Island, Hall County, Nebraska, herein referred to as
<br />"MORTGAGEE ".
<br />THE PARTIES RECITE AND DECLARE THAT:
<br />a. MORTGAGEE is the owner and holder of a certain Promissory
<br />Note, made by MORTGAGORS to MORTGAGEE, dated December 29, 1982, and
<br />secured by a Mortgage bearing the same date as said Promissory
<br />Note, and recorded in the Office of the Register of Deeds of Hall
<br />County, Nebraska, on January 6, 1983, as Document #83- 000115, which
<br />Mortgage is now a lien on premises located in the City of Grand
<br />Island, Hall County, Nebraska, known as 1015 East Oklahoma Street,
<br />Grand Island, Nebraska, 68801; said premises further described in
<br />such Mortgage as follows:
<br />Lot Four (4) in Block Three (3) in Valley View
<br />Subdivision, in the East Half of the Northeast Quarter
<br />(El /2 NE1 /4) of Section Twenty -two (22), Township Eleven
<br />(11) North, Range Nine (9), West of the 6th P.M., Hall
<br />County, Nebraska;
<br />and on which there is now due the principal sum of THIRTY -SIX
<br />THOUSAND FOUR HUNDRED NINETY -ONE DOLLARS SEVENTEEN CENTS
<br />($36,491.17).
<br />b. MORTGAGEE is also the owner and holder of an Extension
<br />Agreement made by MORTGAGORS to MORTGAGEE, dated October 26, 2001,
<br />on which Note and Extension Agreement, there is now due the
<br />principal sum of THIRTY -SIX THOUSAND FOUR HUNDRED NINETY -ONE
<br />DOLLARS SEVENTEEN CENTS ($36,491.17).
<br />C. MORTGAGEE is also the owner and holder of the Mortgage
<br />referred to above.
<br />d. MORTGAGORS are now the owners in fee simple of the above -
<br />described premises and affirm liability for payment of all of the
<br />above - described mortgage debt.
<br />e. The parties hereto wish to consolidate and combine the
<br />above - described Mortgage with this Mortgage Extension Agreement, so
<br />that they shall form a single lien of THIRTY -SIX THOUSAND FOUR
<br />HUNDRED NINETY -ONE DOLLARS SEVENTEEN CENTS ($36,491.17) on the
<br />above - mentioned premises, and to extend the time of payment of the
<br />principal indebtedness secured by the Note and Extension Agreement
<br />and Mortgage as provided herein.
<br />FOR THE REASONS SET FORTH ABOVE AND IN CONSIDERATION OF THE
<br />MUTUAL COVENANTS AND PROMISES OF THE PARTIES HERETO, AND OTHER GOOD
<br />AND VALUABLE CONSIDERATION, THE RECEIPT OF WHICH IS HEREBY
<br />ACKNOWLEDGED, MORTGAGORS AND MORTGAGEE AGREE AS FOLLOWS:
<br />I.
<br />Nothing in this Agreement shall change or affect in any way
<br />the conditions and stipulations of the Promissory Notes and
<br />Mortgage above - described and referred to, except as herein stated,
<br />and such Note and Extension Agreement and Mortgage are hereby
<br />ratified and confirmed.
