Gr ' wait <br />801 o ' 'ver Rd. <br />St. Lib . _ 8872 <br />TRANSFER ON DEATH DEED <br />In accordance with the provisions of the NEBRASKA UNIFORM REAL PROPERTY TRANSFER <br />ON DEATH ACT, NEB. REV. STAT. §§ 76-3401 TO 76-3423 (the "Act"), Shirley Greenwalt, (the <br />"Transferor"), hereby states that upon the death of the Transferor, the following described real estate <br />(as defined in NEB. REV. STAT. § 76-201): <br />Plat of a tract of land in the Northeast Quarter of the Northeast Quarter <br />0(NE'/4NE1/4) of Section Four (4), Township Twelve (12) North, Range Nine <br />(9) West of the 6th P.M. in Hall County, Nebraska more Particularly described <br />as follows: Beginning at a point on the North line of said Section Four ( 4), <br />said point being Nine Hundred Ten and Two Tenths (910.2) feet west of the <br />Northeast Corner of said Section, thence west on Section Line a distance of <br />Two Hundred Eight (208) feet, thence south and to the left at an angle of <br />90°00' a distance of Two Hundred Eight (208) feet, thence east and to the left <br />at an angle of 90°00' a distance of Two Hundred Eight (208) feet, thence north <br />Two Hundred Eight (208) feet to the point of beginning. Said Tract containing <br />.993 acre more or less, of which .157 acre more or less is in the county road <br />right-of-way, <br />shall be transferred to Nicole Greenwalt, Eric Greenwalt, Greg Greenwalt, Daniel Greenwalt, John <br />Greenwalt, Zachary Greenwalt, Kaitlyn Greenwalt, Wyatt Greenwalt, Levi Greenwalt, Lilah <br />Greenwalt, and Jessica Greenwalt (individually as "Beneficiary," or collectively as "Beneficiaries") <br />in accordance with the terms and provisions of the Act. In the event any of the Beneficiaries named <br />above predecease the Transferor, the deceased Beneficiary's share shall be transferred to the <br />remaining Beneficiaries. <br />This Deed is revocable even if the Deed or another instrument contains a contrary provision. <br />The Transferor states that the real estate described above is not agricultural land. <br />WARNING <br />The real property described above remains subject to inheritance taxation in Nebraska to the same <br />extent as if owned by the Transferor at death. Failure to timely pay inheritance taxes is subject to <br />interest and penalties as provided by law. <br />WARNING <br />Any designated Beneficiary above is personally liable, to the extent of the value of the real property <br />transferred to the Beneficiary pursuant to this Deed, to account for Medicaid reimbursement to the <br />extent necessary to discharge any such claim remaining after application of the assets of the <br />Transferor's estate. Any designated Beneficiary above may also be personally liable, to the extent of <br />the value of the real estate described above that is actually transferred to the Beneficiary pursuant to <br />this Deed, for claims against the Transferor's estate, statutory allowances to the Transferor's <br />surviving spouse and children, if any, and the expenses of administration of the Transferor's estate to <br />the extent needed to pay such amounts by the Personal Representative of the Transferor's estate. <br />1 <br />
